Palm Beach County State Attorney David Aronberg says Jack Smith is close to using a ‘nuclear button’ to remove Judge Aileen Cannon from the Trump classified documents case over her jury instruction order.
“He is close to pushing the nuclear button,” said Palm Beach County State Attorney David Aronberg, according to NBC News. “It is a high burden to reach, and it is rarely done, but her proposed jury instructions may have pushed him to the breaking point.”
Last month Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts went apocalyptic.

Jack Smith earlier this week threatened to take the jury instruction fight to the appellate court.
On Thursday Judge Cannon declined Jack Smith’s demands of her jury instruction order as “unprecedented and unjust.”

Palm Beach County State Attorney David Aronberg and other defense attorneys are now encouraging Jack Smith to go nuclear and remove Judge Cannon from the case.

Whatever the most illegal thing that can happen at this point is the thing that will happen.
If a prosecutor can remove a judge simply because they don’t like a decision? What does that say about Justice?
A judge would have to have made a decision that was completely indefensible.
On what basis? Getting a ruling you don’t like?
What a cry baby. Zero chance of success.
Jack Smith wants to try the case on his terms that this was “espionage” and does not want to allow the other side to be able to present their defense. He wants to be able to do this before the election. He wants to bully a young female judge in order to get his way. Maybe she should challenge the legitimacy of his irregular appointment.
He doesn’t have that power. And her rulings are well within the mainstream.

So the prosecutor can replace the judge? What kind of justice system is this? I mean I’ve heard of “judge shopping” but I didn’t know you could return them afterwards.
Jack Smith is a heart attack (or aneurysm) lookin’ for a place to happen.
No, the prosecutor cannot remove the Judge. The only nuclear button he is close to pushing is his own self-destruct button. “I don’t like your decisions” is not a basis.
He can push all the buttons he wants.
I can only tell you the court system is not eager to let participants have judges removed, and certainly not over jury instructions, which I believe are still preliminary.
The circuit Court could simply rule on the jury instructions, which would also be unusual (to do so in advance of the trial).
Jack Smith certainly is a nasty little shit and a hot head.
Switching judges because this one case happens to have drawn a Trump appointed judge, would pretty much delegitimize the court system. And the judges know it.
So I think such a change is highly unlikely.
Just the fact that articles are written depicting poor Jack Smith as needing to “push a button” to switch judges, demonstrates a lack of understanding of the court system.
judges pretty much don’t give a damn whether they tell prosecutors or defendants to go to hell.
If the day comes that is no longer true, the game is over.

So, Jack Smith thinks he can approach the Appellate Court to replace Judge Cannon? Really? Is he that CRAZY? Jack Smith in the first place is not a real counsel— and Merrick Garland knows this. This is not going to happen. More bullcrap from desperate people.
