Students from 19 states yesterday filed a class-action lawsuit seeking hundreds of millions of dollars from California officials for charging them significantly more than illegal aliens pay to attend state-run colleges.
The 42 plaintiffs say California state lawmakers and the University of California board of regents knowingly violated a federal law enacted in 1996 that says any state that offers discounted in-state tuition to its illegal aliens must provide the same lower rates to all U.S. citizens.
California has a "unique" statute barring discrimination on the basis of geographic origin, said lead attorney Michael J. Brady.
Some students in the University of California system could be eligible for as much as $300,000 in total damages, he said.
The plaintiffs' attorneys say the lawsuit was filed in a state court in Yolo County on behalf of about 60,000 U.S. citizens who have paid out-of-state tuition to attend public higher-education institutions in California since 2002.
Mr. Brady said out-of-state students are paying $20,000 more than illegal aliens per year to attend schools in the University of California system. In the California state university system, the difference is $11,000 per year.

If only the UC had just NOT admitted illegals, and taken a few more of these out-of-staters paying out of state tuition. DUH. Why must we always suck everything up for lousy illegals who don’t love this country, don’t care about this country, and are only here for the freebies?? Every which way we turn, we are accosted to pay for these freeloaders, and NO ONE WILL PUBLICLY ADMIT IT.
When can we ever turn around this sinking state? WHEN?
Wow! About time someone did this. Perhaps the only way to get the idiotic liberals to see the stupidity of their policies is to air them out in court. I sure hope they win.

The suit is going nowhere unless the supreme court hears it. Even then, I am not sure how the supreme court will rule. The issue is standing. Past courts have thrown out the suit on claims that students have no standing. If the students do not have standing, who has standing? Standing only impedes conservatives when seeking redress. Liberals never worry about standing even when they clearly are not directly involved. The disaster of the environmental laws is largely attributed to granting standing to groups that should not have standing.
I have not read the legislation, but the excerpt reads that they have to charge the exact same, whether state residents or not.

Whoa! Who knew? Well, obviously not the Regents. This is some stuff. Unfortunately, I think the students’ case falls under a question asked in one of my first law school classes -
Q. What is a judgment worth?
A. Nothing if you can’t collect on it. (While other students struggled with what seemed a trick question, my hand shot up right away. My step-father was a litigator and I learned the difference between winning and recovery early in life.)
Considering Kali’s current financial state, I don’t know the extent to which students can recover, but good luck to them!

I sympathize... Maybe FReepers/conservatives should do what the Libertarians planned: get a certain number to commit to moving to a state to take over & show what can be done when gov’t is done correctly. How about Idaho? ;-)

Excellent point. The salient point of the law would be the loss of federal funds, but you are spot-on WRT the 0’s administration actually following through on upholding law. They appear to be circumventing laws at a cyclic rate.
