Is he injured now or do we have to wait to see if he is court martialed?

What's the stop the government from just keeping him reassigned so it doesn't go any further and he can not claim injury?

That's right (after he's exhausted the military court route). Question then becomes...will SCOTUS continue to evade the issue.
