Yes, they could be subject to prosecution if they certified him (ex. Pelosi) as being Constitutionally qualified knowing that he was not...and certified the E.C. votes knowing that they should not have been (i.e. Congress). The difficulty would be in proving that they did so knowingly and with intent to circumvent the Constitutional requirements.

What a circular argument they give. If he's a usurper...he can not be impeached.

I think it means we are screwed. We now have a military judge who would rather send a man to Leavenworth than take on a treasonous Congress.
No doubt the good judge got a 3 a.m. phone call with a "suggestion" on how to avoid "causing trouble".
The best he can hope for is to be the splinter in the eye of congress that starts the process of impeachment. Impeachment is the required avenue. The high crime is fraud.
Regardless of his fraud, Sobarkah was elected by the people. The people have a process for extracting a fraud.
We dont want a General marching into the oval office with guns drawn... until after impeachment and conviction by the Senate and his subsequent refusal to vacate and submit himself for deportation.

Exactly. Besides, IIRC, LTC Lakin is asking the court to determine if Barry is legit or not. He is NOT asking the court to impeach Barry. If this is what the judge ruled, yet another ridiculous statement by an "eligibility" judge as Lakin isn't asking the court to impeach him.
If Lakin's argument is correct, then every member of the military can walk away from their base tomorrow.
Anyone who thinks that a military judge is going to issue a ruling that would do that is dreaming.

This woman has kicked the can to Congress and the Supreme court. She is subservient to both the President and congress, and will not cross that political line.
This is heading straight to the Supreme Court. We now have a man with injury, and his Judge is denying him access to evidence that could clear him because it would be a political embarrassment. Clearly, this is now an injustice that needs prompt remedy.
Mr. Lakin now has standing. This Judge just gave it to him.
Uumm judge, no one gives a damn hoot about Congress's sensibilities. LTC Lakin is getting rail-roaded.
