Man pleads not guilty in Conn. brain-eating case

A Floridian charged with hacking a Connecticut homeless man to death with an ax and eating some of his brain and an eyeball has pleaded not guilty to murder.

The Connecticut Post reports (http://bit.ly/wEqKXa) that Tyree Smith, a Florida resident who grew up in Ansonia, Conn., also waived his right Monday to a probable cause hearing in Bridgeport Superior Court.

They have the death penalty in CT.They don’t *use* it but it *does* exist.If he’s convicted,however,he probably wouldn’t qualify because of the SCOTUS ruling that you can’t execute the retarded or the mentally ill.

By "use" it I was thinking about actually carrying it out.My understanding is that they've only carried it out once since 1960.Yes,they do *impose* it from time to time,including in the case you mention.However,CT is trending even further to the left these days so I can easily see them banning it before too long.
