BALTIMORE, - An attorney for the 7-year-old Maryland boy suspended for biting his breakfast pastry into a gun shape said he is seeking to have the boy's record expunged.
Robin Ficker, the attorney hired by J.B. Welch, father of Park Elementary School student Josh Welch, said he filed an appeal Thursday with Anne Arundel County schools Superintendent Kevin Maxwell to have the two-day suspension from March 1 expunged from the 7-year-old's record, The Baltimore Sun reported Tuesday.
Ficker said keeping the suspension on the boy's record could hurt him later in school.
"Who knows what doubt he's not going to be given the benefit of later?" Ficker asked.
Bob Mosier, a spokesman for Anne Arundel County Public Schools, said the appeal is being reviewed.
"Park Elementary has taken the worst possible interpretation of Joshua's actions," Ficker wrote in the appeal. "The chewed cereal bar looked no more like a gun than the puzzle pieces of the states of Idaho, Oklahoma, or Florida. ... There is no evidence that any other student was frightened by the pastry."
The whole episode reeks of fatcat bureacratic idiocy. Can you imagine how many kids would have been rounded up for playing cops and robbers just a few decades back?

What’s to review? How long is that supposed to take? The longer this goes on, the dumber the clowns who perpetrated this look. If the father has to drag them into court, they’ll be subjected to more ridicule.

When a child is harassed like this for an innocent action, we are lost. No hope at all for redemption. Why bother trying any more? We can defeat 0’s party in the next election but this crap will continue.

My son was 16, had the mental make up of a 12 year old, developmentally delayed in other words, he was AMBUSHED, and BEATHEN TO DEATH WITH A FENCE POST, by a SOCIOPATH! who wanted the thrill to see what it felt like to kill some one.
Had to fight the first parole hearing just 10 months after it took 2 years to get a lousy 20 year plea bargain from 1st degree down to 2nd degree, then fought 5 more, kept the sociopath in prison until he 'maxed out his bad...er 'good' behavior time in prison. Yeah, he was not a model prisoner. Where is the call for a Fence Post ban?
It is also the reason I CCW, the turd made threats to kill any one who testified against him, who would he target more the one who forced the system to work or no one who had to testify because there was not a trial?
