Police Abuse or S.O.P.?
Personal Experience | highnoon

Posted on 02/24/2014 8:30:33 AM PST by highnoon

Both of the following events occurred in Williamson County Texas, in a small town with a Hippo Mascot.

The week of Christmas 2013 I was pulled over for ‘not displaying my blinker for more than 100 feet’. After the normal chit chat, the officer asked for consent to search my vehicle, to which I refused. I was told that K9 was in route and to wait outside the vehicle. K9 never arrived and after 15 minutes of waiting I was released.

Fast forward to Saturday evening 2/22/14. I pulled onto the roadway and was immediately followed by a member of the local police force, who after a few seconds turned his headlights off, then turned them back on. I stopped at an intersection with the officer behind me, proceeded forward when the light turned green and pulled into a Walgreens – the officer did not follow. I sat in the parking lot for 2 or 3 minutes then pulled out and went on my way. In less than a minute I was being pulled over.

Reason given was ‘non visible license plate’. He then asked why I had pulled into and out of the Walgreens. I responded that I was avoiding trouble based on the events that occurred the week of Christmas. He asked to search the vehicle to which I consented. I mentioned the presence of my prescription Adderall and after a VERY thorough search the officer completed his search. He emerged with my pill bottle and mentioned that the bottle was 2 years old, and that the contents (30 mg) did not match the label (20 mg). I was told that my pills were being confiscated and that I had a few days to speak with a detective, present a valid prescription for the pills or a warrant would be issued. I have the most recent Rx bottle – labeled for 30 mg and I’m preparing to visit with the detective when it occurred to me to ask some of you for advice.

I feel that I have a target painted on my vehicle due to the refusal to consent to the Christmas week search. I also feel that if the reason I was pulled over on Saturday was the LP light, the officer should have made the stop instead of playing cat & mouse with me. These are things I want to say out loud to them, but restraint of pen & tongue has me asking the members of FR first.

Any and all input is appreciated and valued. Thanks in advance.

Seek immediate legal representation and cease any direct contact with the Hutto PD without your lawyer present.

GET A LAWYER - NOW - and don’t consent to anything / and don’t speak to anyone without a lawyer present - they aren’t here to help and guide - theyre here for settling scores, and making sure you comply and boot lick, and to get convictions - convictions = job security

Get an attorney and tell him the truth. The officer was intimidating you and he made it appear that if you didn’t consent to the search that he was going to keep ishing for a reason to ticket or arrest you. That’s referred to as official oppression. Sometimes its hard to prove in small towns where the whole court system is rigged by locals who’ve lived there all their lives and are guven their positions because of their bloodline. They’ll all work against you. You might file a formal complaint with the local FBI office after you speak to your local congressional representative. They love to get their name in the news anyway they can. The one thing Hutto will not like is publicity about this situation because once someone starts the ball rolling every other victim inluding the locals will come out about it.

I wouldn’t talk to the detective or any police. Instead, hire an attorney.

Correct. The police do not exist to clear you of crimes. They exist to arrest you, guilty or innocent. NEVER SPEAK TO A COP, EVER, ABOUT ANYTHING. Get an attorney to do all your talking for you.

Go in with a lawyer. Do not go in alone.

Yes, you have been targeted. Police have obama egos, huge and touchy.

Make sure from now on to keep your medicine in it's bottle when it is with you. Yes it is a pain.

I would go so far as to get a different car if you can with the plate in your wife's name.

Never let them search your car unless they have a warrant. Never let them into your home. Never let them just "take a look around". The police (sadly) are not your friends.

I thought you wanted to pull me over, so I went into a Walgreen's parking lot so we ... WE ... would not be a road hazard .... you never followed so I figured you had accidently turned your lights off then on.

No ... you may not search my car.

No ... I CAN'T wait, my wife is sick and has to go to the hospital.

Number one, you need to get the hell out of there. Number two, why did you allow them to search your vehicle without a warrant? Number three, you need to talk with a lawyer.

And just between us girls, the police never engage in idle chit chat. Every word they speak is for a purpose. Never, never, never, never engage them in "idle" conversation. That is if you value your life and freedom. The rule of thumb is avoid contact with them like the plague and that is not possible, remain absolutely mute. The police are not your friend.

Why do you drive around with amphetamine in your car?

Why was it prescribed? Narcolepsy? ADHD?

How many do you take a day?

Amphetamine is a heavy duty drug and can affect your behavior and thought process in ways you may not even realize.

I would try to get off of amphetamines.

They can hold a person at a traffic stop for a legally undefined "reasonable period" to get a K9. Evidently that means 15 minutes in their opinion. Both of these stops were definitely fishing expeditions.

The best thing to do is get the prescriptions together, go into see the detective and give an exceedingly boring description of whatever causes you to need the medication.

Misuse of prescription drugs is a huge problem these days along with poor management by physicians. People that really need meds are caught in the middle.

I’m generally on the side of folks who’ve been stopped and bullied into a search if these are in towns which are using these tactics to confiscate your cash by claiming it is drug money or even confiscate the car. This is a elaboration of the old ‘speed trap’ and works for the police because of anti=drug laws. A town on IH 90 east of Houston was notorious for these types of stops.

If you refuse the search they will often take you into custody for the ‘violation’ which results in a trip to the local jail, a wait for a magistrate for bail and a future trial and towing of your car where it will be searched to ‘inventory’ your personal property in the car.

But this usually happens in towns which are using these tactics as a cash cow on folks passing through since innocent people have to pay for an attorney and go to trial to get their property back.

But I’d like to know more since you appear to be a resident of the town and not passing through. Do the police have any reason to suspect you of illegal activity or have a grudge against you? Small town cops usually don’t want to harass a citizen of their own town.

I will not get the hell out of here. I have worked in this town for 18 years.

I allowed them to search my vehicle because I had nothing to hide, and STUPIDLY hoped that it would cause the BS to stop.

I've already spoken with my civil attorney - he's consulting w/ a criminal atty.
