Article 1, Section 8 of the Constitution does not give congress any power to legislate about food or drugs. That is a State police power, and rightfully belongs at the State level.

FDA and congress can pound sand.

Because the federal government has no constitutional power to ban them. Just like it didn't have any constitutional power to ban alcohol.

Actually, they DID have the power to ban alcohol, by Amendment to the US Constitution.
The fact that they couldn’t enforce it was the prime driver in the rescission of that Amendment.

Actually the ban was on the manufacture and sale of alcohol, not the consumption. A moot point but one that kept a lot of thirsty citizens, my folks included, out of the graybar hotels.

Feds shouldn't be involved in police matters anyway. That power is reserved to the States. So, yes, it's good that they are getting pardoned, but bad that they weren't jailed by their States to start with, as is constitutional.

Situational ethics need not apply. If it's wrong, it's wrong.

Couldn’t agree with you more on that score, sir.
The Enumerated Powers have been ignored for over a hundred years. That should be one of the primary guides in a CoS, IMO.

Everyone would be happier if counties had more power than the state or federal level. Counties now have more people than the original states did. Conservatives want less government and leftists want more. Each could have their wish because leftists are highly concentrated in the big city counties. Most political conflict comes from leftists trying to impose their big gov lifestyle on those outside their county lines.
