Father gets restraining order against 5-year-old kindergartener

KENOSHA COUNTY , Wis.,A Wisconsin father has taken out a restraining order against a 5-year-old kindergartener who has allegedly been bullying his daughter at Prairie Lane Elementary School in Kenosha County.
Brian Metzger took out the order after his daughter's classmate allegedly threatened her and physically attacked her.
"She came home and said a student threatened her by saying, 'I want to slit your throat and watch you bleed,'" Metzger told WISN.
According to Metzger, the male student has also bothered other students in the class and the school has shirked its responsibilities in dealing with the situation.
"I think they should have done something a lot sooner. They've kept him in the same classroom with my daughter throughout this until Wednesday morning because Tuesday night I showed up with a restraining order," Metzger said. "What they're doing, their policies aren't good enough."
Metzger is hoping to get the boy permanently removed from the school.
"There's always two sides to every story," Kenosha Unified School District spokeswoman Tanya Ruder said.

I see this as a fighting fire with fire situation.
The school is legally in loco parentis.
The school says it can't discipline.
The school says it is helpless when it comes to controlling children.
The school will call the police and get the courts involved over the most trivial of situations.
So, this father just followed their example. He got the courts involved over this situation.

If a 5 year old is saying stuff like ‘I want to slit your throat and watch you bleed’ then the problem is not the kid or the school but this kids parents unless this kid is some kind of mini psychopath.

It would raise one hell of a red flag with me if I had a small daughter and a classmate told her he wanted to slit her throat!
It continues to surprise me the lengths schools will go to avoid common sense responsibilities, while jumping on minor matters. For instance, if the little girl brought a Bible to school, or wore something with an American flag, or drew a picture of a gun, guess how fast the school would react. But a death threat against the same little girl? No big deal.

First, I'm going to guess that your 10 year old has never threatened to "slit the throat" of your 5 year old. That's a specific threat. Not "I'm going to kill you." Secondly, you have established (again conjecture) an atmosphere where your kids feel safe in your home. That is probably not available to this father's child at the school.
Good friend of ours had their daughter (who was in 6th grade at the time) repeatedly threatened to be raped by a pretty unbalanced classmate of hers. The school's response was roughly your response. "Kids do crazy stuff." So they pulled her out.

The teacher could step in, but she won’t. The Principal could, but he won’t. They are all afraid of lawsuits. I say good for this father for stepping in. This kid is probably REAL trouble - and they can be at this age, if they are Hood Impaired, let’s say, or raised by feral older folks (I won’t use the word ‘adults’). When he’s older, this kid will just be bigger trouble. May as well nip it in the bud. (ex-teacher/ then homeschooler).

Enterprise - you are spot on. I’m with you. I’d protect my daughter too. Grown up psychopaths do not start out as sweet little kids who suddenly turn. They hone their bullying and abusive behavior from youth.

I remember two particular bullies from elementary school. One was an overall jerk, but when the teachers intervened his parents would come in and raise all holy hell. We just tried to stay out of his way.
The other one was more serious. He was 14 years old, in class with 6th graders. He joked that he was the only one in his family that wasn't in jail. We were all deathly afraid of him. One day he told a male teacher "F... you," and the teacher slapped him across the face. Thankfully, nothing happened to the teacher. Today he would probably be arrested.
About a year later, when we were in 7th grade, my best friend had said something that the bully thought was disrespectful. So one day, on the way to school, the bully held a knife to my friend's throat, and walked him to school. This went on every day for a while. It got the point that my friend would greet the bully by name, and the routine would be repeated. Finally the bully tired and it was over. The last I heard of him, he was doing life without parole for murder.

Agreed.
And there are NOT always two sides to every story. The truth is the frickin’ TRUTH.
Now we don’t know who is telling the truth here yet, but it is NOT a matter of assessing the balance between one relative statement and another.
Damn but I get tired of everyone having a meaningful version based on their income, skin-color, past grievance-status, and how and with whom they utilize their pee-pees.

In my case, the five year old son was threatening the ten year old daughter in rather similar, specific language. He probably picked up the language from an old Dragnet or Bonanza episode, as he doesn't get to watch much in the way of new stuff (heavily supervised web viewing only). If a ten year old threatens a five year, that is quite different. The five year old isn't even at the age of reason.
Second, I knew kids who talked like that with nothing behind it. For my own part, I was more interested in doing violence to the school building itself while empty. It never turned into more than an eight year old's daydream. I cannot imagine how many ways I would have been suspended or expelled from my public elementary school if I acted the same way there today.
You do make two good points:
The atmosphere at home is different than the atmosphere at school. My guess is that the atmosphere even at a "good" school is different than the atmosphere at a "good" school in the early '70s. We home school, so we don't know first hand.
Second, a five year old threatening another five year old (especially when the aggressor is a boy and the threatened is a girl) is more serious than a five year old threatening a ten year old. When I was that age, most of the boys and girls largely ignored each other, having different interests.
A sixth grader threatening rape is far different, and your friends did the right thing.
I didn't want to join the regular chorus of "ya gotta homeschool", and the crazy zero tolerance finger pointing-bang-bang stuff.
I guess I find it jarring when the courts are involved at this level. The teachers are hog-tied and must cede authority to the admins, who in turn cede authority to the local police, who in turn recive SWAT team gear from the state and the feds, and before you know it, a five-year old repeating lines from a Flintstones' gangster to another kid has a SWAT team over. We're not there, but we are in that trajectory.
If men rejected Truth (as in God), or at least Natural Law (a necessary reflection of God), then you get the land of crazy.

Back in the 80's I recall reading a news account of a 7 year old boy in California who killed a playmate by bashing in his head with a rock........
If some little kid threatened my daughter by saying I want to slit your throat and watch you bleed, I'd be very concerned about the kid.
