Bi-Partisan Committees Discuss Protocols for Inevitable Article V Convention

An Article V convention, also known as the Convention of States, has quietly become a political inevitability, as state legislators all over the nation consider how to rein in the federal government’s unprecedented overreach and abuse.

Last week, a group of over a hundred state legislators – most appointed as delegates from their states – came from all over the nation to Indiana to prepare for the Convention of States. The legislators, who hailed from thirty-three states, attempted to establish the structure and rules of a convention. Though Article V is clear about Congress’s duty to call a convention upon two-thirds of the states passing applications, each convention sets its own rules once it convenes.

Though Convention of States support is mainly comprised of Republicans, Democrats and independents are joining the cause as the IRS scandal, the NSA, privacy concerns, and other instances of federal government’s overreach dominate the news.

Yes. The fact that the word ‘Bipartisan’ coupled with other words like ‘Democrats’ and ‘Independents’ makes me entirely comfortable with this untried process. Yep, I’m just pleased as punch.

You do know congress can also propose new amendments too....

There are a number of screwball amendments they have already prposed.

The so-called “tea party” is actually comprised of disaffected people from both major parties who want to reign in the Feds. I’m all for it. I say “so-called” because “Tea Party” is often a badly-applied, misleading term, like “racism.” Even “conservative” doesn’t cut the mustard in this case.

Yes Article fivers have no idea what they are asking for. The only reason Dems are joining up is to try to subvert any rollback of the big govt police state.

You can tell when the term has been hijacked by idiots or those with a far left agenda.

Every single one of them make a mistake that those who wish to preserve our freedom never make.

They leave out the “s” in tea parties as if some singular group existed with a unified goal.

Be aware...
Leviathan has an insatiable appetite and he's hungry.
This creature will not go quietly. Leviathan sees this (or will very soon) as a threat to its very existence. All stops will be pulled as this creature fights for its very survival.
This will NOT be a civil "meeting". Treachery will abound and it will be hard to tell friend from foe.
I fully support the Article V convention because its our only hope. Unfortunately, most State office holders view their job as a stepping stone to moving up to the "big money"...Congress and Senate.

For all of you skeptics of the Article V convention, I would ask you this. If you are so afraid of a run away state convention, are you also afraid of the run away congress we have now? The Article V Convention of the States simply is a way our founders gave us to reign in big government. This is the only way left to get power back to the states where it belongs and away from disconnected Washington elites and insiders. We the people do not have a say in government anymore. They run roughshod over all of us and thumb their noses at us afterward. I'm for anything that can put a stop to big bloated government. Before you make judgment, please read up on the process. It is not at all simple and will probably take years, but at this point, what do we have to loose?

The amendatory process under Article V consists of three steps: Proposal, Disposal, and Ratification.

Proposal:

There are two ways to propose an amendment to the Constitution.

Article V gives Congress and an Amendments Convention exactly the same power to propose amendments, no more and no less.

Disposal:

Once Congress, or an Amendments Convention, proposes amendments, Congress must decide whether the states will ratify by the:

The State Ratifying Convention Method has only been used twice: once to ratify the Constitution, and once to ratify the 21st Amendment repealing Prohibition.

Ratification:

Depending upon which ratification method is chosen by Congress, either the state legislatures vote up-or-down on the proposed amendment, or the voters elect a state ratifying convention to vote up-or-down. If three-quarters of the states vote to ratify, the amendment becomes part of the Constitution.

Forbidden Subjects:

Article V contains two explicitly forbidden subjects and one implicitly forbidden subject.

The first is from the American Legislative Exchange Council, a conservative pro-business group. This document has been sent to every state legislator in the country.

Proposing Constitutional Amendments by a Convention of the States: A Handbook for State Lawmakers

The second is a 1973 report from the American Bar Association attempting to identify gray areas in the amendatory process to include an Amendments Convention. It represents the view of the ruling class of 40 years ago. While I dislike some of their conclusions, they have laid out the precedents that may justify those conclusions. What I respect is the comprehensive job they did in locating all the gray areas. They went so far as to identify a gray area that didn't pop up until the Equal Rights Amendment crashed and burned a decade later. Even if you find yourself in disagreement with their vision, it's worth reading to see the view of the ruling class toward the process.

We know EXACTLY what we’re getting into... A way the FOUNDERS gave us to save what’s left of the country...

Dems are welcome. Radical Dems even more because as the MINORITY in this process, they will expose themselves even more...

I find it more interesting that you jump on almost EVERY Article V thread and give us your “concerns” but NEVER offer an alternative...

Article V’ers are all ears... If you’re not willing to help, I would respectfully ask that you refrain from posting your “concerns” on these threads...

There’s important, serious work going on trying to save the Republic...

Since you seem to stalk my comments and by the way its flattering you should know that my solution is very simple. Follow the Constitution specifically the 10th Ammendment state sovereignty. By the way many constitutional experts agree with me. We do not need to be amending the constitution to save the Republic.

I would urge you to simply advocate for the states to nullify all of the illegal and unconstitutional laws, regulations and Eo’s that are being handed down by an out of control Federal govt.

Also you might want to revisit the 1st Amendment which gives even me the right to freely express myself. Or maybe you plan to get rid of that pesky item at your Article V convention. I have no plans to shut up about something I think is a poor idea just so Mark Levin can sell some books.

I have no problem with you expressing your opinion no matter how WRONG it may be...

I have asked you more than once for you to tell us which GOVERNOR of a state is going to practice REAL nullification... (crickets)

How is following the Constitution working out for you?

I guess a repeal of the 17th is a bad idea because we would have to amend the Constitution that you value and want to follow yet THAT ONE issue would go a long way in restoring the Republic and returning some state rights...

For the record, I do not own a Mark Levin book... All this information is freely available to those who seek it...

Then why did you just ask me to stop commenting on this thread? You had a problem about a half hour ago until I corrected you.

For your information the reason people voted for the 17th Amendment in the first place is because they were so upset over the cronyism and corruption going on under the policy of the state legislatures selecting the US senators. Now the people who want to repeal the 17th amendment and let the state legislatures go back to selecting the US senators are doing it for the same reason. Its a catch 22.

As long as you have a lawless President and a bureaucracy that is too large and run by Progressives they are not going to follow any amendments to the Constitution anyway. They are totally ignoring the Constitution now.

The states are slowing starting to step up and assert their sovereignty. Its slow but like a snowball it will gain speed along the way.

We’ll just agree to disagree on the methodology...

A repeal of the 17th & term limits will eliminate many problems we have in DC. Many constitutional scholars agree with that opinion.

Unless we have a congress that is willing to take back it’s power from the Executive Branch, the president will continue to consolidate power in both the Executive & Judicial branches... Congress is almost irrelevant now...
