Government Cleared in Deaths at Waco Old Article
NYT ^ | SEPT. 21, 2000 | IM YARDLEY

A federal judge today dismissed the wrongful death civil lawsuit brought by Branch Davidians, clearing the government of any wrongdoing in the deaths of about 80 members of the religious sect during the disastrous 1993 standoff at the group's compound near Waco, Tex.

The judge, Walter Smith Jr. of Federal District Court in Waco, issued an order that found that federal agents had acted legally and could not be held liable for the deaths. His ruling ended a legal battle that lasted nearly seven years and came after an advisory jury in the case and a special counsel, former Senator John C. Danforth, both issued similar findings in July.

NOT in Article: 76 cult members, including 17 children, were either buried alive by rubble, suffocated by the effects of the fire, or shot.

What to note here that the largest massacre in US modern history was conducted by the US Government, and no one was held accountable (except the 17 innocent children).

Posted as a reminder that the worst killers of innocents are Goverments, to include our own.

if the govt wanted to arrest that leader fellow, all the agents had to do was stop him on his way around town, he went out regularly to shop and visit people

there was no need of a military assault on his home, especially with all those other people there including children

imho this was a terrible terrible terrible terrible event, if accidental then THAT needs to be SURE to be corrected to prevent it from ever happening again. If not accidental then those responsible should be made to pay

*** the govt wanted to arrest that leader fellow, all the agents had to do was stop him on his way around town, he went out regularly to shop and visit people ***

Before the massacre, I remember seeing him on 60 minutes or some show. They talked to him as he was walking to the Post Office. I think he said he went there almost every day.

I have never heard how Waco was not a violation of Posse Comitatus.

Yes the guy regularly walked /went about town. He felt he had nothing to hide and he frequently talked with other people and could easily have been met away from endangering all those other people and children included. Government assembling and unleashing military attack, assault forces on American citizens or families in their homes in USA — this shows the desperate need for good citizens to be well prepared to defend themselves and their neighbors— as well as they possibly can anyways . (The more Americans are prepared, the less likely “regular” agents or any bad cops will just break in to your home and attack you). Tanks, I realize are much the worse. It is tragic nothing has been done to try to restore some justice from this horrid violation of americans’ civil and constitutional rights.

I wonder what the ruling would have been had it been a MOSQUE.

The judge, Walter Smith Jr. of Federal District Court in Waco, issued an order that found that federal agents had acted legally and could not be held liable for the deaths.

The first shot was fired by an ATF agent who was heavily armed with a firearm he wasn’t properly trained to use and wounded an unarmed David Koresh at point blank range. The agent’s second shot was fired wildly and killed Koresh’s unarmed two year old daughter. The agent “acted legally” according to Federal District District (Waco) judge, Walter Smith Jr.

After the initial shootout and burial of those Davidians already killed, the government needlessly and repeatedly drove over the graves.

During the seige the Feds took what they described as a “carrot and stick” strategy —sounds pretty good, huh..?

The conciliatory side was mostly social scientists and the stick side was being commandos. These sides had little in common and seldom communicated.

The end effect to those inside the compound appeared highly schizophrenic; assurances would be given and not 1 minute later they would suffer some sudden, dramatic attack, like shooting or the audio recorded playing of the screams of dying rabbits.

This played into the hands of the Kook Leader, who admonished that the doomed world outside was composed of deceitful beguilers.

History will not clear the government on this one. It’s obvious this was an extremely over the top heavy handed operation much like the other, more recent, event at the Twin Peaks restaurant but this thread is not about that. Just noting the similarity.

If John C. Danforth is inon this, it’s almost certainly the wrong decision.

And many of those children were his! He required the married couples in the compound to allow him to have sexual relations with the wives.

I miss the days when conservatives were solidly against government abuses of power. It seemed like after 9/11, most conservatives became statist bootlickers who wanted to flush the Constitution down the toilet and worshipped Dubya like he was some kind of emperor.
