Judge Awards Nearly $13 Million to Women Who Say They Were Exploited by Porn Producers
New York Times ^ | 01/02/2020 | Michael Levenson

A Superior Court judge in San Diego tentatively awarded nearly $13 million to almost two dozen young women on Thursday, ruling that they had been tricked into performing in pornographic videos that derailed and uprooted their lives and led several to become suicidal.

The ruling capped an unusual 99-day civil trial that exposed the bait-and-switch tactics and false promises deployed as part of a scheme to induce young women, who would not otherwise consider filming pornography, to fly to San Diego and shoot a pornographic video.

...snip...

Judge Enright found that the women had been lured with Craiglist ads that offered to pay them around $5,000 for photos or video shoots. The ads did not indicate that any nudity or pornography would be involved.

“Wanted,” one ad read, “beautiful college type preppy girls,” for video and photo shoots.

The women who responded to the ads said they were directed to innocuous websites, with pictures of clothed women, that asked for their contact information and photographs.

The ads turned out to be from the producers of GirlsDoPorn, who were seeking women to make so-called amateur pornography, which often features fresh-faced actresses paired with seasoned male performers.

Once a newly recruited woman had flown to San Diego, she found herself alone in a hotel room with two men about to shoot a pornographic video, Judge Enright wrote.

At this point, the producers had the women sign documents containing “dense and ambiguous legalese,” which they falsely described as guarantees that their videos would be distributed only on DVD outside of the United States and would never be published online, Judge Enright wrote.

“Defendants rush and pressure the woman to sign the documents quickly without reading them and engage in other deceptive, coercive and threatening behavior to secure their signatures,” Judge Enright wrote...

Men lure college girls who have never participated in porn, and likely never would have, through innocuous clothed modeling sites advertised on craigslist.

They offer crazy amounts of money.

They utilize "ringers" who convince the girls that everything is legit.

They fly them to San Diego where it's revealed that they'll actually be doing adult modeling but not to worry because the scenes will only be released on DVD to an elite clientele in Australia and New Zealand. Never on the internet. Nobody will ever find out.

The girls reluctantly agree, quickly sign mumbo-jumbo contracts, and often find out they will be paid far less than originally promised.

The footage is realeased on the internet on both free and subscription sites.

If the girls complain, the men, though the (now defunct) "porn wikileaks" website they operate reveal the girls' real names, social media profiles, and often the names of their friends and family, and their social media profiles. Friends, family, potential employers, and everyone finds out about the porn videos.

And they never knew what was up?

Hollywood will have extras “do nudity” male and female with no advance notice for feature films. “Oh, you won’t do it? then you aren’t in the scene and don’t get paid. Goodbye.”

While the actions of the defendants are despicable, this seems like another example of young people with no common sense, and an ability to make themselves victims. How hard is it to realize when you are a college student that some stranger who wants to film you having sex is asking you to do something you should just say no to?

If you did your job as a parent your children should be able to recognize bad situations by the time they are 18 years old, and avoid them. Deciding to shoot a porn film for pay with other actors is not a good decisions regardless of whether or not your participation is supposedly going to be kept secret. Didn't these girls parents ever tell their daughters to just not have sex with strangers in return for money?

“Oh, you won’t do it? then you aren’t in the scene and don’t get paid. Goodbye.”

Siskel and Ebert said this back in the early 1980s. If a girl is not willing to do nude scenes, she is “out the door”, and there are dozens of other girls waiting in the wings to take her spot.

Stupid judge . . . those women knew exactly what they were doing when they took their clothes off in front of cameras.

Yes, it seems like the girls have no common sense, no intuition, if you will, that these are bad situations to be in.

And in such a situation, when a girl discovers the reality of being expected to perform in pornography, wouldn’t she get out of there at that point? I’m assuming that nobody would use force to keep her from leaving.

What part of:
- I’m in a hotel room
- with two stranger dudes I never met before
- and cameras set up
- and am told to take clothes off and have sex
do these girls NOT understand as just plain wrong on many levels??

Unless they all were forced with threat of violence, I don’t think it’s a jump to conclude it wasn’t about the act/actions but the insufficient money paid.

Yup.

Advice for anyone and everyone:

1. if it sounds too good to be true, it is.

2. if anyone wants to take pictures of you and fly you somewhere without you having an agent or already being established as a professional in the business, it’s too good to be true.

3. if you find your “professional photoshoot” is taking place in a hotel room, walk out immediately. It’s too good to be true.

This is advice for anyone and everyone.

They need to be compensated also for the value of the films... since porn is a big business.

Residuals every time its eyeballed.

I’m shocked porn is the number one moneymaker in the world.

What’s the old saying? Sex sells. Every man wants to see beautiful women from a distance and make vicarious love to them.

The world’s oldest form of entertainment will always be with us.

So it’s okay so long as they pay more money? Just a contract re-negotiation? Going to bet every one of the participants cashed their checks.

There may be some cases like this but the internet is filled with women who absolutely know what they are doing, modelling and posing for nude and porn photos and videos, and who are under no false impressions. They know exactly what they are doing and why and in most cases are age-verified and must sign waivers.

Don’t expect us to believe it’s the innocent 1950s - which weren’t, really, just more hidden.

In a free country, you should know what you’re getting into. If it doesn’t feel right, walk away.

That’s what I would do if I was a young woman.

I suspect they are holding the young woman’s ticket home. . . If there is one at all. She’s likely been promised a long term modeling contract and got a one-way ticket to get there and has no place to go, and likely very little money, no idea where she is, and the location is likely not a good neighborhood where an attractive young woman would feel safe to be ejected with her luggage. Those are likely her options being presented to her if she refuses. A more insidious dilemma, similar to the situation where an unscrupulous man has driven his date into the boonies and told her to “put out” or she’s going to have to walk the multiple miles back home in high-heels. . . In the cold, dark night, with no idea which way to go.
