Filibuster in Danger in Lame-Duck Session
Human Events ^ | 11/08/2010 | Brian Darling

Liberals don’t like the filibuster. They want to rid the Senate of it in the next few weeks so newly re-elected Senate Majority Leader Harry Reid (D-Nev.) can exclude Republicans from all aspects of the legislative process. Conservatives should watch closely to see if Reid tries to exterminate the filibuster from the Senate rules without a fair vote.

Conservatives need to fight any change of the filibuster rule. Without it, the Obama Administration and Sen. Reid will ignore the will of the American people. Reid and his allies will railroad through left-wing nominees to the courts and the executive branch—in short, transforming America without legislation.

Rule 22 of the Senate rules establishes that 60 senators are needed to shut down debate on a bill or nomination. This rule is sacrosanct. The rule protects the rights of individual senators to extend debate and offer amendments. It protects the American people from politicians’ passing legislation quickly without the input of the populace.

If Reid uses a procedural tactic to rid the Senate of the filibuster—and all he needs are 50 Senate allies to do it—he can pass every piece of legislation sitting on the Senate calendar.

Rulz? We don't need no stinkin' Rulz.

That said, it'd be good to get a Constitutional Amendment to anchor the 60 vote super majority requirement.

If the Rules don’t work, the outcome will be much worse!

Let them try. All hell will break loose if they even think about doing that!

If they think they got the asses kicked on Nov 2nd they haven’t seen anything if they try more railroading through more of the same crap!

We must keep an eye on them.

They are more dangerous now than ever, because many of them have NOTHING to lose. Especially those in the House.

We could see more horror here in these next two months than we have seen during the past two years.

Conservatives need to fight any change of the filibuster rule.

The filibuster rules were changed years ago so that, instead of the nonstop Congressional sessions that led to reading the phone book, etc., all one Congresscritter or another has to do is say that they are filibustering an issue and it is tabled rather than interrupt all Congressional business.

Despite what the DBM says, what we have yet to see is the political payback (if any) by the Dems who A) lost their seats and B) are mangry at the Dem leadership who lied to them to get them to support the trifecta's radical agenda in exchange for their elected seats. I think the Dem backlash is out there.

There are 21 dem senators that have a lot to lose in 12. And november 2 showed them the risk they are taking siding with Reid. I think the lame duck session will be an epic fail.

I don’t think this is a good strategy.

Kirk is no stalwart defender of conservatism or the constitution. He’s already making rumblings about going all Maverick on the GOP. I’m not going to lift a finger to get that guy seated early because he’s given no incentive to believe he can be trusted.

We’ll just have to have some hope the “red” state Dems that now include states like PA and Wisc. put the brakes on the most extreme items out of self preservation.

Someone needs to whisper in their ears that they’re TOAST come 2012 and that we will ensure that starting now. The 2012 campaign is on.

Funny, the Dems loved the Filibuster when they were in the minority. I seem to recall a number of very well qualified judges that were nominated by Bush but failed to be confirmed because Fat Teddy threatened to filibuster.

Which just goes to show that the dems are lying scumbuckets who believe anything they want is acceptable.

Go ahead Harry the-war-is-lost Reid! Make our day. When you succeed with this banning of the filibuster rule, you seal the tomb of any Dem legislation after 2012. It is a double edged sword.

Liberals don’t like the filibuster when they have a majority in the Senate. Liberals LOVE the filibuster when they are in the minority.

They have a lot to lose. They don't evaporate in January. They have to go home, find jobs, whatever, and the people who voted them out will be their neighbors, possibly their bosses. If they try to pull such crap in the Lame Duck, they know their lives will be hell for the next ten years.

The rules can only be changed at the beginning of a session.

It will only be valid for the upcoming Congress.
