Geragos deconstructs prosecution's case against Peterson

Defense attorney: Fetus was born full-term therefore defendant's not responsible for murders

By Jason Dearen, STAFF WRITER

REDWOOD CITY -- Scott Peterson is a cad not a killer, his defense attorney said Wednesday as he began an assault on the very essence of the evidence against Peterson -- when his wife and child died.

In the scenario cast by attorney Mark Geragos, the child was born alive weeks after Christmas Eve 2002, the date prosecutors say his mother, Laci Peterson, had been killed.

"If this baby was born alive, clearly Scott Peterson had nothing to do with this murder," Geragos explained to the six men and six women of the jury. .......

Peterson's lawyer attacks investigators' work

By Brian Anderson

CONTRA COSTA TIMES

REDWOOD CITY - Saying Scott Peterson was "stone-cold innocent," defense attorney Mark Geragos blasted the police detectives Wednesday who investigated the murder of Laci Peterson and the thin case he said they cobbled together against her husband.

In his first chance to lay out his side of the case, Geragos said Modesto police believed early on that Peterson had something to do with his wife's Dec. 24, 2002, disappearance and they worked to prove only that. Through slipshod detective work, lies and far-fetched theories, they built a laughable case from circumstantial evidence that led to the prosecution of an innocent man, he said.

"The evidence is going to show beyond any doubt that not only is Scott Peterson not guilty.""......

REDWOOD CITY -- The same gravity that is holding together the "12 galaxies" apparently had enough pull to draw San Francisco's eccentric sign-toting icon, Frank Chiu, and others looking for a little collateral publicity, to the Redwood City Courthouse on Tuesday for the start of the Scott Peterson murder trial.

Parked near the courthouse in a van covered with biblical and anti-abortion messages, Ronald Brock of San Diego sought attention for his message that killing an unborn child, through abortion or any other means, is a crime.

"Murder is murder, give Conner justice," read a banner on the van. Conner was the name Scott and Laci Peterson planned to give their unborn child before a pregnant Laci disappeared in late 2002. Her husband is facing two counts of murder for their deaths.".....

Geragos: Peterson didn't do it

Geragos: Peterson didn't do it

1:23 p.m., PDT: REDWOOD CITY - Scott Peterson had nothing to do with his pregnant wife’s murder - and his legal team will prove it, defense attorney Mark Geragos declared dramatically this morning during his opening statement.

“The evidence is going to show clearly, beyond any doubt, that not only was Scott not guilty, but stone-cold innocent,” Geragos told jurors.

Peterson, 31, of Modesto, came under media and police scrutiny after Laci Peterson vanished Dec. 24, 2002. But Peterson had no opportunity to kill her and their unborn son, Conner, Geragos said.

Evidence will show the baby was born alive, the Los Angeles lawyer announced in a series of revelations. They include:

Laci Peterson knew that her husband bought a fishing boat shortly before she vanished - and “was in the boat Dec. 20.”

The Petersons didn’t talk about the boat, even during......

A couple of years ago, I was deeply involved in forum wars, here and over at Court TV, about a trial where the defense attorney was praised to the skies and the prosecutors were continually slammed.
There were times when I thought that Nancy Grace and cyncooper and Bunny and I were the only people who could see through the defense tricks.
Fortunately, I was wrong. The jury saw right through it, and delivered a guilty verdict.

It is so hard to imagine that we were in the minority on FR. It was a challenge. I'd better stop there. :)

The good part was getting to know you, Red ... and cyncooper. Both of you smart ladies with good hearts ... and super sleuths!

They better not do the thumbs up thing!!

Uh, yeah, you're right they'd better not. Otherwise it will end up like the Tyco trial where the woman juror gave the very visible nod to the crooks on the defense. It caused an uproar which resulted in a mistrial less than two weeks later.

CA juries do worry me a bit.

Outside of the OJ jury which California verdicts did you find out of line?

Martha Stewart show used to be on from 9-10, their time?

Maybe this meringue business that Geragos is so smug about might later come back to stab him in the back!

Scott's official story is that he left his home at 9:30--which would mean Martha was only half over.

What if the alleged "mention of meringue" on the 24th happened AFTER 9:30?

Uh-oh.

read a ways back that Amy identified the pants as the ones she WAS wearing. She just wasn't wearing the ones that she had her facial done in in the afternoon. This is getting really mixed up. The story keeps changing.

"... because he talks lovingly about Laci and says he hopes to find her."

Yeah, but for the first few days after Laci "disappeared", IIRC, he forgot to even MENTION his dear darling wife to Amber!

Yes, we've heard that he left that sweet little message on Laci's cellphone. We've also heard that Laci's cellphone's battery had been dead for weeks before that, and Scott knew this.

My question: if your cellphone has a dead battery, how can someone leave a message on it? This may well be possible... I just don't know. Can someone explain this to me?

(I've never left a cellphone around for long periods with a dead battery.)

It's the Simpson trial that I was referring to specifically but what I meant is that so many California people are really liberal and they appear to be taken in by "Hollywoodesque" type Lawyers. THAT's what worries me. As one lady from the midwest says, IF that happened here, he'd already be on death row. I hope I'm wrong. But hearing that jurors are smiling at Peterson and NOT showing disapproval of the Peterson's behaviour is what I mean. THEY should be very disturbed by this.

I wish they COULD talk about what a despicable, childish, bratty narcissist he is, but the state can't bring up his character--unless Scott decides to bring up his "good" (yeah, right) character first.

I know that narcissism is more than just character, but I doubt the courts see it that way; as you know, they have a very narrow definition of mental illness. No room for the vicissitudes of all Scott's neuroses, lol!

Thanks, CO.

Do you get the feeling that Geragos is happy to spread as much confustion as possible with these sorts of questions?

Greta also said the spa owner said that she did NOT distance herself from Scott. We're going to be chasing ourselves around in circles without the transcripts. :-(

Thanks for the clarifications, Keep 'em coming. :-)

Yes, the meringue episode of Martha Stewart was aired on Dec. 23. BUT, in his opening statement, Geragos played a bit of the tape of Martha's (alleged) Dec. 24 show, and she makes a BRIEF MENTION of the word MERINGUE in that show too--says Geragos. Personally, if I were the prosecutors, I'd be sending off to Martha's production company or archivist or whatever, to get a verified copy of the REAL Dec. 24 show. I wouldn't put anything past Geragos--especially after that phony "survey" he trotted out about "juror bias".
