As we all know, for Democrats, the law is a mere annoyance something that needs to be circumvented to achieve the desired Democrat ends. This is particularly true on election day.
Walking Around Money
Im sure that many of you have seen this Democrats and/or Democrat affiliated groups near polling places giving people walking round money to vote on Election Day. This is an illegal practice. Note the following federal law:
18 USCS § 597 (2004)
§ 597. Expenditures to influence voting
Whoever makes or offers to make an expenditure to any person, either to vote or withhold his vote, or to vote for or against any candidate; and
Whoever solicits, accepts, or receives any such expenditure in consideration of his vote or the withholding of his vote--
Shall be fined under this title or imprisoned not more than one year, or both; and if the violation was willful, shall be fined under this title or imprisoned not more than two years, or both.
As you see, this is an illegal activity. If you see this practice going on on Election Day, alert the authorities immediately cops with probable cause to believe a person or persons is (are) violating this law have the authority to make an arrest on the spot. Further, there will probably be vote fraud hotlines set up to report this kind of thing.
You can give cops the necessary probable cause to make an arrest by showing them a copy of the law or merely citing the statute (18 USCS 597), telling them that you personally observed the law being violated, and telling them, in detail, whom you saw violating the law.
The people offering the money and the people who receive/accept the money may both be arrested and charged.
Please tell anyone you know about this law, and please take action to be on the lookout for this on Election Day. As we say in New York if you see something, SAY something!
One would think that a free ride to the polls would represent an expenditure in lieu of cabfare, but, the law is, itself, driven by politics.

Well, you probably remember in 2000 they actually had pictures and proof of Dim operatives giving people in Madison, Wisconsin money and cigarettes to go in the polling place and vote for Gore. Did anything ever come of it? Nah. What's some little 24 year old patrolman gonna do if you call him out to the polling place with this type of complaint?
Don't get me wrong. I'd do it in a heartbeat. I'd throw a Southeast Texas fit and make a scene. Probably to no avail, however.

Actually, it was in Milwaukee and the Dimowit DA of Milwaukee County, a GEN-U-INE machine politician, didn't bother to push the issue.
The NYC 'socialite' harpy who was handing out the goodies may have paid a $100.00 fine or something...
The perps usually get off with a delayed slap on the wrist, but if they can be taken out of circulation and away from the polling place for the day, that would certainly help.

What is the constitutional jurisdiction for this law to be enforced within the boundaries of a sovereign state?
There are only two constitutionaly enumerated methods of federal jurisdiction within a state:
Powers of Congress
Article I, Section 8, Cl 3, the "commerce clause."
Article I, Section 8, Cl 17 state property owned by our federal government with a state's consent.
Obviously, the act of offering an individual money, lunch, or a beer, who maybe standing on a city street corner or holed up in a tavern, to vote for a specfic candiate, does not meet the jurisdictional requirements of the constitution for this law to be enforced.
Why would a presumed "conservative" at a site know as "FreeRepublic" advocate the unconstitutional enforcement of federal law when the term "conservative" implies the desire to "conserve?"
In this case "conserve" the tenants and covenants of the constitution.
Advocating the enforcement of unconstitutional federal laws is what a Democrat/liberal is known to do.
Actually, you're wrong. This law does not rely on the commerce power; the federal government has broad power to regulate the conduct of federal elections.
I happen to be an expert in this area.
Yeah, like telling a cop you saw this crime will have any effect on them. Their response will more than likely be "I can't do anything about it." After all it isn't like they were speeding or overparked or something equally dangerous.
Have a camera ready to take pictures.
