defense attorney Mark Geragos [yawwwn, blink] is expected to go on another rant [yawwwn, stretch] and ask the judge to dismiss the case due to prosecutorial misconduct [yawwwn, clear throat]."
If he does, he'll do it outside the presence of the jury. How can he rag on Brocchini if Brocchini is not on the witness stand? And since the state is doing its case, they are the ones who determine who will take the stand today. If they don't call Brocchini, how will Geragos get him in there to attack him?

I think the whole duct tape flap was an effort to distract the public (i.e., jurors who are exposed to the media) from Shawn Sibley's damaging testimony. I've noticed that MG likes to leave a good impression, somehow, at the end of every week. Good application of psychological principles, BTW.

The entire long weekend filled with breathless pundits, reporters, defense lawyers discussing the fact that the prosecution has no credibility, calls for a mistrial.
I'd say Geragos pulled it off beautifully. Wonder who the little birdie was who leaked the behind closed doors conference details?...

I don't know, and the more I thought about the duct tape thing... Didn't he say, he got many bad or fabricated tips, and that was just one? So, only thing I can say is that the judge can determine if it should be disregarded to the jury? I can't see any harm in that testimony...not for a mistrial or admonishments.... ;o)

IMO, no harm.... there is more to scotty and guilt. It is up to the judge, and jury to decide on verdict, and misconduct. Duct tape if I recall, was found wrapped around Laci in the Berkeley East Bay waters.
The truth! Do you think Markie Garagos tells the truth after HE publicly stated on the shows he was on BEFORE he was consulted to represent Mr Scott Peterson, that Scott is involved in the death of Laci and Conner? That the evidence points to Scott?
Oh well....
