DNC threatens Florida poll watchers in legal letter

To all Republican Party Election Day poll watchers:

Your name has been filed to serve as a poll watcher on Election Day, on behalf of the Republican Party or a Republican candidate. The Democratic Party recognizes the legal rights of poll watchers, under Florida Election Law, to perform their lawful duties.

We want to make sure that all poll watchers recognize the importance of their role in this process and understand the repercussions for abusing that role. As a poll watcher, you have the ability to protect one of the most sacred rights of our democracy. Regardless of party affiliation, we can all agree that no citizen should be deprived of their right to vote without good cause. Whatever the outcome on Election Day, the challenge process must not be abused as a means of harrassing or intimidating voters, or of obstructing the ability of lawfully qualified and registered citizens tovote safely, efficiently and conveniently.

You should be aware that, under Florida law, a poll watcher must explain in writing and under oath the basis of a challenge. This affirmation requires that the poll watcher have personal knowledge of the facts upon which the challenge is based.

Florida law provides that a challenger is to be removed from the polling place if his or her activities slow down the voting process or intimidate voters. Indeed, it is a crime under Florida law to be in a polling place to "intimidate, threaten or coerce or attempt to intimidate, threaten, or coerce, any other person for thepurpose of interfering with the right of such person to vote." (Fla. Stat. Sec. 104,0515(3)). Therefore, should a challenger knowingly make a false challenge, that person could be subject to criminal prosecution.

Please be advised that the National Democratic Party and the Florida Democratic Party will insist on strict enforcement of that law. You have now been provided notice of the law, and thus, please govern yourself accordingly.

How is reminding you of the law a threat?

In this case, if the letters were sent to only Republican poll watchers and not to Democrat poll watchers, it could be considered a form of "Profiling".

Someone should remind the DNC that it's also illegal to fraudulently register to vote, to misrepresent one's identity to vote, and to knowingly allow dead people to vote.

They would be better served to have addressed this petter to ALL poll watchers. I hope Republicans sent a similar letter.

Absolutely. They managed to get poll watchers kicked out of OH polls by a judicial decision this morning, and this attempt to intimidate us in Florida indicates that they're planning on a heck of a lot of cheating and don't want anybody to see it - or dare to report it. I found the last paragraph particularly offensive.

The threat is that it comes on a page entitled "Important Legal Notice," it implies that any attempt to challenge a vote in and of itself is intimidation and hence illegal, and then it makes it clear that the DNC intends to look for excuses to prosecute.

We have all been instructed on what to do and what not to do, and are well aware of the law. The DNC is implying a threat here and hopes that some of our more timid volunteers will simply not go to their polling places tomorrow.

At the bottom, it reads:

How about we post the law and penalties about illegal voting at the polling place. Oh yes, we can't. They consider it intimidation.

Just as only those who are not among government-certified minorities can be guilty of "racism", only Republican poll-watchers can be guilty of "intimidation", no matter how many loud, abusive union goons and antiwar freaks the DNC has stationed in front of the door.

They learned their Alinsky well. He taught that rules are a weapon to use against them as believe that the rules matter.

Dont let these empty threats scare you - fight the good fight. The democrats are scared wear this as a badge of courage. Thank you each and everyone of you who are voting and working the polls for the re-election of Bush.

I got mine today as well, I'll be at precinct 24e in Coral Springs, FL. Ya'll at the dnc come on by and visit. But, don't mess with me. I will make sure every one who has the LEGAL RIGHT and IDENTIFICATION gets to vote. This letter really PI$$ED ME OFF...... I think I will use it this saturday out at Markham park, after a three day party celebrating a 300+ EV win.
