Is Declaration of Independence unconstitutional?

In a season typified by lawsuits against manger scenes, crosses and even the words "Merry Christmas," a California case is taking the "separation of church and state" one step further – dealing with whether it's unconstitutional to read the Declaration of Independence in public school.

Attorneys for the Alliance Defense Fund filed suit Monday against the Cupertino Union School District for prohibiting a teacher from providing supplemental handouts to students about American history because the historical documents contain some references to God and religion.

"Throwing aside all common sense, the district has chosen to censor men such as George Washington and documents like the Declaration of Independence," said ADF Senior Counsel Gary McCaleb. "The district's actions conflict with American beliefs and are completely unconstitutional."

don't see why i should even read this article - the declaration came BEFORE the constitution and therefore cannot be judged on its terms.

Given that the DoI was written before the Constitution, I wouldn't see how...

Don't worry though...If this measure stands, in a few years, the Constitution will be considered un-Constitutional!

What has that got to do with your interest in reading the article, if I may ask?

The real question is, is distributing the Declaration in school unconstitutional. Subversives like the ACLU would have you believ that it is. After all, look at the closing words: "And for support of this Declaration, with a frim reliance on Divine Providence, we mutually pledge to each other our lives, our fortunes, and our sacred honor."

I really am the newbie when it comes to your legal system, but how on earth could the US Declaration of Independence illegal because it would be against the Constitution ? Without the Declaration you wouldn't even have a Constitution, right, or am I missing something obvious here ?

I was thinking just this morning that we desperately need to invent a new word for "pretending to take totally absurd statements seriously". The old standards have become totally and permanently ineffectual: Newspeak, Big Brother, Brave New World, Animal farm have all become inaudible and invisible.

How to deal with it? a new word is desperately needed to dismiss intellectual garbage for what it is, with a maximum economy of words.

Who on earth would want to have a dialog with anyone who would suggest that the Declaration of Independence is unconstitutional? or the Pledge of Allegiance? I seriously believe that a new word is needed.

Any suggestions?

The headline is deliberately misleading. The question is whether any reference to God or a higher power may be made in our public schools.

Since the Declaration of Independence contains such references, the far left would like to make the legal case that it can't part of our education process.

It is patently absurd, of course.

If not checked we will eventually use our own laws and freedom to outlaw itself! We're well on the way already,

The article explains teh title.
A certain district in California has decided that reading the Dec of Independence is wrong due to it's references to God and religion.
Seems they think it is against seperation of church and state.
So in court it is being argued that they are censoring George Washington and history.
