Bush Attorneys Ask U.S. Supreme Court to Take Schiavo Case

TAMPA, Fla. (AP) - Gov. Jeb Bush went to the U.S. Supreme Court on Wednesday in a bid to keep a severely brain-damaged woman alive over her husband's objections.
At issue is whether Bush overstepped his authority when he pushed through the Legislature a law in 2003 that allowed him to have Terri Schiavo's feeding tube reinserted. Six days earlier, her husband had the tube removed with a judge's approval.
Dubbed "Terri's Law," the measure was struck down by the Florida Supreme Court aerlier this year as a violation of the separation of powers before the legislative and judicial branches.
On Wednesday, the governor's attorneys filed an appeal with the nation's highest court in which they argued that the Florida Supreme Court ruling has "ominous" implications for "the most vulnerable of our citizens who cannot speak for themselves."
George Felos, the attorney for Schiavo's husband, Michael, called the appeal another delaying tactic by the governor. He said he doubts the U.S. Supreme Court will agree to hear the case.
"I think every independent legal scholar who has looked at this case and the decision of the Florida Supreme Court will agree there is no real arguable basis for federal jurisdiction," Felos said.
Schiavo is at the center of one of the nation's longest and most bitter ritght-to-die battles, a dispute that has pitted her husband against her parents, Bob and Mary Schindler.
Schiavo, who will turn 41 on Friday, suffered severe brain damage after collapsing in 1990 because of an eating disorder. Some doctors say she is in a persistent vegetative state with no hope for recovery, while doctors brought in by her parents say there is a chance she could regain some faculties.
She left no written instructions, but her husband has argued that she made it clear before her collapse that she would never want to be kept alive artificially. Her parents dispute that.

Attorneys argue 14th Amendment was violated

MIAMI, Florida (CNN) -- Attorneys for Florida Gov. Jeb Bush are asking the U.S. Supreme Court to become involved in the ongoing case of a brain damaged woman, Terri Schiavo.
A legal appeal by the state was filed with the court Wednesday, calling on the justices to accept the case for review.
Schiavo's husband, Michael, has been trying to have a feeding tube keeping his wife alive disconnected. Her parents contend their daughter would not have wanted the system disconnected and have been fighting to see that it stays in.
The two sides have been involved in more than a decade of litigation.
The Republican governor became involved in the legal battle last year, when the Florida Legislature passed a measure, referred to as "Terri's Law," that allowed Bush to replace the feeding tube after a court order had it removed.
In September the Florida Supreme Court found Terri's Law to be unconstitutional because it violated separation of powers. (Full story)
On Wednesday, Bush's attorneys argued the U.S. Supreme Court should hear the case because, they said, the Florida high court misapplied the separation-of-powers principle, violating the governor's and his ward's due process and equal protection rights under the 14th Amendment.
"It has taken our nation many years to make good on its commitment to equal justice for persons with profound cognitive disabilities," wrote attorneys for Bush.
"Unless the State of Florida retains the power to protect the rights of its most vulnerable citizens to due process and equal protection under the laws, the Fourteenth Amendment's guarantees will apply only to those who are capable of defending them on their own."
The Supreme Court may not decide whether to take the case for several weeks at least. If it accepts it, oral arguments would be scheduled, and a ruling would not be expected for a number of months.
The case is Bush v. Michael Schiavo (guardian for Theresa Schiavo).

If you go look up Michael Masinter on yahoogroups Disability-Civil-Rights you will see ACLU connections to Miami University, etc. he is a teacher there and a chair of the ACLU. I also have proof that various people in the U.S. DOJ Disability Rights Section monitor that group (as I have return e-mail receipts of them being out of the office when I posted to that group before I was kicked off) but again have done nothing to help Terri, information was posted on that group proving attempted murder and felony neglect, medicaid fraud, etc. but also some of the same people in the U.S. DOJ have ignored responding to my certified letters.. including the mini-Cd of evidence proving the attempted murder, etc. (they accepted the certified letters but never was I contacted by them).
You can also find information on Michael Masinter on the web .. not just Yahoo! Groups plus I have a long e-mail of information on him for anyone who wants it.
All in all, it was a fairly balanced article. However I take exception to the idea that hospice could by any stretch of the imagination be called a "health care facility". That's just ludicrous.
