TERRI SCHINDLER SCHIAVO JANUARY 2005 Dailies: News Digest, Restating the Obvious & Thank Yous...
Free Republic & Various Sources ^ | December 30, 2004 | Floriduh Voter

The Terri Schindler Schiavo Daily Threads are created month to month as we watch local and national news regarding Terri and her family.

Since Terri's supporters are in every time zone, you may see something FIRST. Please share news with us that you don't see here already. Now, why would you want to do that? Terri's Daily Thread for September/October of 2004 was viewed over 15,000 times. Terri's November Daily Thread was viewed over 6,000 times. December's thread is over 3,000 views.

More and more good folks are finding out about Terri and that judicial tyranny would take her life, but for lots and lots of prayer and non-stop lobbying of relatives, friends, clergy, our leaders, the media, a passerby, a cashier - ANYONE who you feel comfortable chatting with.

Folks always want to know how can this be in America or on earth for that matter? Unfortunately, this is really happening to an innocent woman who just celebrated her 41st birthday. She's not the only one but she's the one with devoted parents and siblings who knows what's in Terri's heart. Terri has a strong will to live. That's apparent. It's been 14 years.

Besides, feeding tubes have been around practically since the Civil War. They are not high tech devices. Terri is "not hooked up to machines". Her feeding tube is the diameter of a piece of spaghetti.

Talkin' about Terri is the best way to lobby for her. It is a salespitch to save her life and subsequently, many lives. If you've never sold anything in your life, START NOW. START WITH TERRI.

See Terri's flash movies if you need more information. You can see for yourself that's she's interactive and follows the doctor's instructions.

Visit: http://www.terrisfight.org

NOTE: Terri's December Dailies are noted as a source above. There are lots of important links at the very top of that thread. If you missed Terri's Celebration of Life, you can click on it from there.

Thanks for posting that. Please make it a separate thread if you can, so that we can gain maximum exposure for Terri. This is so awful! I will ping others as soon as I can. I'll explain later.

I thought the stay that Greer ordered would remain in effect until "all" legal appeals (including SCOTUS) were exhausted. Anyone?

That's what I thought too. Let's ask Juan. He stays up to date and seems to understand these filings.

Terri's estranged husband doesn't need to bother fighting in court, because he already owns the judge. Judge Greer is representing Michael Schiavo.

TERRI'S LIFE IS NOW UP FOR GRABS SO TO SPEAK.

This afternoon, attorney for Michael Schiavo, George Felos, issued a press release praising the 2nd DCA's (District Court of Appeal) decision to deny Terri's family the right to a new trial based upon her rights to religious freedom.

Felos wrote, "There is currently no stay preventing removal of the feeding tube in the constitutional litigation between MICHAEL SCHIAVO and Governor Bush, now pending in the United States Supreme Court."

WE WILL BE VIGILING AT HOSPICE WOODSIDE VERY SOON. I HOPE that someone steps in and issues another STAY.

jeb.bush@myflorida.com comes to mind.

"I thought the stay that Greer ordered would remain in effect until "all" legal appeals (including SCOTUS) were exhausted." Since the 2nd District Court of Appeals dismissed Terri's religious motion, Judge Greer can sign an order to have Terri's feeding tube removed. Felos may be at Judge Greer's door tomorrow (Dec 30) to get Greer to sign the order.

Thank you for posting the new press release here. Felos KNEW ahead of time that the 2nd DCA would rule against Terri's parents, I'd bet my last dollar on it. Felos KNEW ahead of time which is why he appeared to be so generous on December 28th about giving up all the local fights.

He's a shape shifter with friends in black robes. I was out all day. WHAT HORRID, DESPICABLE NEWS. The 2nd DCA must think that the Pope is just an old man. What a real shame. FREEDOM OF RELIGION IS DYING HERE IN FLORIDA. The Pope's a nobody???

So was FATHER MURPHY, I guess, who was run over by a car earlier in 2004.

Message from Cheryl Ford

Terri's Life in Grave Danger

This afternoon, attorney for Michael Schiavo, George Felos, issued a press release praising the 2nd DCA's (District Court of Appeal) decision to deny Terri's family the right to a new trial based upon her rights to religious freedom.

Felos wrote, "There is currently no stay preventing removal of the feeding tube in the constitutional litigation between MICHAEL SCHIAVO and Governor Bush, now pending in the United States Supreme Court."

Felos obviously finds great pleasure in adding such a statement to his press release. He boldly hinted in his press release that he will quickly file a motion to have Terri's feeding tube removed.

Please be prepared to organize a vigil at Woodside Hospice in Florida

WATCH FOR FURTHER DETAILS!

Greer makes mistakes all the time. He probably made it sound all encompassing but obviously, it wasn't. This is as serious as it gets for Terri, especially the way the hospice staff obeys Michael's orders as if were king. The problem is they could do anything to her and just say it was accidental. They could pull the feeding tube without telling anyone until it was removed.

We are contacting Florida's House and Senate starting today. Florida Freepers, call the local phone number for your representatives. You catch them locally during the holidays. Bend their ear, but don't bother to call x-senate prez Jim King if you are in his district. He's just a pig.

Thanks, FV

I believe they want to get this done before KEN BURKE is installed as the Clerk of the Courts. Burke WILL take every ward's financial and physical states seriously. The Judges will all be busted if Burke does his job. The Judges would like to SHRED TERRI'S FILES before Ken Burke is installed. I normally wouldn't publish this kind of detail but WE ARE ON TO JUDGE GREER AND JUDGE BAIRD.

If Terri is harmed and her files destroyed, the criminals will walk and continue to sit on the bench.

Ken Burke has his own title company in Pinellas County and is a CPA. Maybe he needs to be red flagged before he is installed??? Greer wants Terri's files to be closed ONLY ONE WAY.

Can you assist me "cyn" and link all the Terri news today on the Jan. Dailies here? I can't make em click.

HERE'S MY POST FROM ONE OF THOSE THREADS.

Monsignor Malonowski is Terri's spiritual advisor and he also tells her jokes which make her laugh - appropriately.

In addition to Terri's rights that have been stepped on, it's about Terri's freedom of religion which is guaranteed by the Constitution of the United States of America.

Terri is a Roman Catholic. If she essentially agreed to (which she did not) ASSISTED SUICIDE which they want to do (STATE SPONSORED MURDER) Terri as a Roman Catholic is subject to eternal damnation.

I think Terri's judges are more suited for that sort of place based upon their partnership with evil.

FLORIDA JUDGES HAVE A PARTNERSHIP WITH EVIL. A FULL PARTNERSHIP.

LET TERRI LIVE! "I am alive and love still."

EVERYONE INTERESTED, PLEASE WRITE TO GOVERNOR BUSH... jeb.bush@myflorida.com

Press Release from the Schindler's Attorneys

Florida Court of Appeals Rules Without Hearing Argument Pinellas County, Florida

Attorneys for Robert and Mary Schindler, parents of Theresa Schiavo, are disappointed with today’s one-line order from Florida’s Second District Court of Appeal. The order, issued without a written opinion, dismissed a motion filed by Terri Schiavo’s parents asking the court to consider a recent Papal Declaration. The court ignored the Schindler family attorney’s request for oral arguments to address these important new issues.

The Schindler family is appalled that the 2nd DCA would treat such an important matter of religious freedom in such a cavalier fashion. They are strengthened in their resolve to continue to fight for the life of their daughter and intend to continue to exhaust every legal avenue available.

The Free Exercise of Religion, guaranteed to disabled patients by both the Florida Constitution and the Florida Religious Freedom Restoration Act is not being adequately protected by the Florida courts in this case. The new Papal Declaration makes a clear statement of Catholic religious doctrine that “water and food, even when provided by artificial means, always represent a natural means of preserving life, not a medical act.

Its use, furthermore, should be considered, in principle, ordinary and proportionate, and as such moral and obligatory.” Attorney David Gibbs III, representing the Schindlers in their appeal, said, “We believe that the Papal Declaration, issued in March of 2004, is new evidence that as a matter of law should require a new hearing into what Terri’s wishes would be today, given her devout faith and her current inability to speak for herself. Although Terri is unable to speak, she is very alert and aware of her environment and interacts regularly with her parents through sounds, facial expressions, laughter, and other non verbal communication.

"Terri is not in a coma; nor does she require any other assistance to maintain her life beyond assisted feeding through a tube.”

American Center for Law and Justice is appealing to the US Supreme Court. ACLJ Asks Supreme Court to Take Terri Schiavo Case - Files Amicus Brief on Behalf of Terri's Parents

http://home.businesswire.com/portal/site/google/index.jsp?ndmViewId=news_view&newsId=20041229005160&newsLang=en

WASHINGTON--(BUSINESS WIRE)--Dec. 29, 2004--The American Center for Law and Justice, which represents the parents of Terri Schiavo in a legal battle to keep their daughter alive, today asked the U.S. Supreme Court to take the Florida case in which the Florida Supreme Court declared unconstitutional "Terri's Law" - a state law enabling Florida Governor Jeb Bush to save Terri from starvation and dehydration. The ACLJ today filed an amicus brief with the high court on behalf of Mary and Robert Schindler - Terri's parents - in support of a petition filed by Governor Bush asking the high court to take the case.

"This is a case that certainly deserves consideration by the Supreme Court and we are supporting the Governor's office in its effort to have the high court take this critically important case," said Jay Sekulow, Chief Counsel of the ACLJ, which is representing the Schindlers in their efforts to defend the emergency Florida legislation that saved their daughter's life. "At the center of this life and death struggle is Terri Schiavo - a woman who has received a death sentence from the Florida courts. The Governor and legislature acted properly and constitutionally in passing 'Terri's Law.' We are asking the high court to take this case to protect the life of Terri Schiavo by upholding the constitutionality of Florida's decision to enact life-saving legislation - the measure that saved Terri's life."

The brief

said the decision by the Florida Supreme Court is an "astonishing and unprecedented ruling" and encouraged the high court to send the case back to the Florida Supreme Court for further clarification prior to accepting the case.

The brief argues that the Florida Supreme Court acted unconstitutionally in its decision when it determined that once any court has issued a decree regarding the care and treatment of an incompetent person, neither the legislature nor the executive branch can take independent steps on behalf of the incompetent person's welfare. The brief states that "the state supreme court's construction of the Florida Constitution to produce such a ruling renders that state constitution, as applied, unconstitutional under the federal constitution ..."

The brief also asserts that Terri Schiavo, a disabled woman whose husband wants her life to end, is not in a persistent vegetative state, as alleged by her husband, that her condition is not terminal and untreatable, and that she is aware of her surroundings and does not want to die - especially by starvation and dehydration.

Governor Bush acting under "Terri's Law," ordered feeding and hydration tubes to be restored to Terri after a Florida trial court had ordered them removed. On behalf of the Schindlers, the ACLJ urged the state's highest court in Bush v. Schiavo to reverse a lower court ruling that struck down "Terri's Law" as unconstitutional. In September 2004, the Florida Supreme Court upheld the lower court decision.

The American Center for Law and Justice, which specializes in constitutional law and the protection of human life, is based in Washington, D.C. and its website address is www.aclj.org.

FV SAYS: Thank you, ACLJ.
