Well .. since the FBI arrested him - I'd say they believe shooting this officer who is currently employed by Homeland Security constitutes a "engaged in" federal officer.

I don't agree with your "off duty" analysis. You're saying that because it was his day off - he somehow is no longer a federal officer. That's just not true. If he's a current employee, he's "engaged in" - which means he's an active duty officer taking a day off. It's simple - if you're an employee of IBM and you take a day off - are you no longer employed by IBM - after all - you're not at work ..??

If, as you're suggesting, he is no longer an official member of the police force when he's off duty - then how can an "off duty" officer - raise up his badge - pull out his gun and take somebody into custody ..??

The only exception I know if is - retired officers - because they no longer carry a badge and a gun and are no longer "engaged in".

Couldn't agree more. If I had the power to decide his fate, I'd opt for a machine gun being inserted up his anal cavity and his hands tied to the trigger in such a way that if he dares move, no question as to what happens next >:D

4 killed at a church event...7-8 injured. Shooter killed...but I didn't hear if they said it was suicide or if he was shot by LE.

Retrial. Same case, new trial. The jury couldn't make up its mind the first time around.

Thanks - there seemed to be so much confusing information about this. I believe that explains why the guy freaked out - he thought he was home free and I think he knew this time he was going down. Now .. he doesn't have to worry about it - he's definitely going down.

Since the ATF was on site, can I assume that the "acquaintance" was killed?

This was a retrial, earlier trial ended in a hung jury and a mistrial was declared.

Listening to a juror on the present case was quite instructive. He said the accused would be staring into the eyes of the jurors and they were intimidated.

IMO, that is what the Nation of Islam men were doing at the OJ trial, sending a threatening message to the jurors.

Friday was the day the victim in this case was going to testify. It is thought that the murderer wanted to kill her too but the civil case was still going on so he burst into the courtroom and killed the judge, court reporter, and fled, killing two more people on the way.

In the end he was a bloody coward.

Might have been different without all the media watching.

Even the helicopters are filming so there was no choice.......damned shame, IMO.

who knew he was French? mea culpa .. but as has been pointed out, by the time this female agent had him, he'd already put up the white flag.

There's no disputing that FBI agents of either gender are better trained than local sheriff's deputies. I just am not comfortable with little women (or men) guarding unshackled lunatics like Nicholls. And I'm sure as hell not willing to lose lives over putting up that imbalance for the sake of PC. And I am a small woman. Vertically speaking, at least ;)

You listening to the news conf? Pretty angry and upset people- and they are going to RESUME the trial he was in for the rape etc charges..

Howard (the DA) just said they WILL resolve this rape trial next week while the charges and such are being worked up on this current situation.

Excellent.

I was thinking they'd move the case he tried to avoid aside, but no. They are going to make him face the original charges.

Actually, I'm watching local news coverage of a mass murder outside of Milwaukee. 5 dead at scene, including shooter, more have died at area hospitals.
