DCF Considers Removing Schiavo from Hospice by Force

State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.

Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'

Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'

Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.

'We're not compelled to look at prior judicial proceedings,' Hadl said.

What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

Doesn't the Fed. Gov't now have jurisdiction over this since Congress gave it to them? Wouldn't this be in conflict with the Fed. judges who have heard this rather than the order of the state judge?

So much for the "RuleofLaw" conservatives preach!

Conservatives will have no moral ground for screaming "RuleofLaw" when the next mayor or governor autonomously legalizes homosexual marriage.

The RuleofLaw didn't matter in Florida, so why should it in Vermont or California.

The slope is getting very, very slippery!

But what would we do if there was a pregnant woman trying to have an abortion, her husband was trying to stop it, her husband won in court, then Pres. Hillary issued a court order to have it done?

She's been a week without the tube before, today is 6 days. We can hold her up in prayer,'till they get to her because I think there will be a big showdown if they do it in daylight. There has been absolutely nothing on the news about this.

The state Police and National Guard would have jurisdiction over the local Police. Also the County Sheriff also has jurisdiction anywhere in the county.

I condemn Bush for not acting sooner.

I don't know what he could have done while the case was kicked up through Congress and the federal courts.

We went through this two years ago. Jeb did plenty back then, and that is why she is alive today.

Talk is cheap on both sides. Look at the picture of the young children being arrested. If that doesn't lead to a call to action by the executive by us "keyboard commandos", I don't know what will.

If it's the DFS acting as an agency, I'd think the officers would be immune to such charges by the letter of both state and federal law.

The wildcard here is the SCOFLAw, who have already shown they are willing and ready to treat Florida law as silly putty.

He can bring the tortious form (which is a civil action) which would be useless unless there were actionable damages to pursue

And if filed by an attorney against a LEO exercising statutory powers, should result in Rule 11 sanctions.

A judge cannot order the executive branch not to execute a law that gives that branch express authority to act, where the law itself has not been found unconstitutional.

If he can, we live in a tyranny and I want no part of it.
