Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.
Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.
On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

About the SC not allowing shackles -- It was funny that here's a guy, the jury has already said he is such a threat to society that he has to be locked up forever, and yet seven supreme court justices, without any indication in law OR in the constitution, simply decided that being in shackles would sway the jury to think the person was even MORE dangerous.
He is a convicted murderer, but what really scares the jury is that he has to wear shackles?
Schumer says we only want a couple of originalists on any court. The originalists ruled right on this case.

Senators Expect To Pull All-Nighter Before Filibuster Vote

WASHINGTON -- The Senate is gearing up for an all-night debate before a critical vote on the fate of the judicial filibuster.
Custodians rolled cots into the Strom Thurmond room as the Senate convened for what is expected to be a lengthy session.
A dozen moderates are running out of time in their effort to hammer out a compromise to avoid a vote on triggering the so-called nuclear option, so named because of the sweeping impact it will have on how the Senate does its work.

I'm always very polite when I call but when I called last week I told the staffer that I'd never vote for Graham again under any circumstances and that the Senatorial part of the ballot will remain blank as long as his name remains on it.
Di's getting a bit long in the tooth to expect to live to see that day.

Did I hear Diane Feinstein right? Did she say Orrin Hatch suggested Ruth Bader Ginsberg and one other judge to Bill Clinton, for the Supreme Court?
I told the staffer I spoke with last week that Graham got his last vote for me. Unless he does an about face on this compromise deal. And I meant it. And so does my husband. He's over as far as I'm concerned.
It isn't a motion to change the rules, in that sense, absolutely correct.
But the fact that the GOP invoked Rule XXII makes it cake-walk easy to convince people that the issue of judicial confirmation is in that rule, and that to get to the confirmation/rejection vote requires first to get past that rule.
If it doesn't require getting past that rule, why did the GOP invoke it?
Sickens me to read that again. Comity in the Senate, Mrs. Feinstein.
I go back to the days of Bob Michel, the Republican Minority leader of the House. Now there was a guy who threw away victory after victory for no reason other than to be liked by the press. He was the reason the Republicans were a minority in the House for so many decades. Gingrich made him sick to his stomach. Michel made Vacant Lott look industrious.
This will make or break Frist's presidential ambitions, although Cornyn or Allen would likely be a better candidate. If Frist fails, the Republicans will properly be ridiculed and laughed out of office.

Graham did fairly well as an Impeachment manager but he voted against one of the articles of impeachment in the end.
He plays a good game...both sides against the middle. He's a McCainiac.
Several months ago when I complained about Graham on the Sunday talk show thread, I got pounded. But we live in SC and I think everyone is catching onto his game...even those who don't live here.
Guess we need to borrow from the international scene and use the cages like the Russians are using for one of the Beslan murderers on trial.
