Senate Debate on Nominations Today the Senate resumes debate on the nomination of Texas Supreme Court Justice Priscilla Owen to the Fifth Circuit U.S. Court of Appeals. Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.

Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.

On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

I thought it was a rules change and a legal one. Aren't the Pubbies doing what Byrd did in the 70's?

[The history of changes to Rule XII] basically voids any argument by the Dems that it takes 60 votes to change a Senate rule. Byrd didn't even get 60 to change the rules but if the Dems argument holds any water they needed 67. Byrd changed the rules 4 times on a simple majority.

Check the historical votes again. Implementation of and changes to Rule XXII were made with at least 2/3rds of members present and voting.

I don't disagree that Byrd has engineered some rules changes on a simple majority, but he didn't engineer a change to the cloture hurdle on that basis.

I'm with you 1000% -- to see the way that Estrada was publicly and professionally humiliated, kept in a perpetual holding pattern, interrogated down to his briefs .. just unconscionable!!

And, yet -- all the libs are falling all over themselves, kissing the ring of the new Latino mayor in LA -- Newsweak giving BIG kudos -- and a "get used to it" tag?? The message is clear -- ANY ethnic is just fabulous UNLESS they're conservative -- hyprocritical maniacs!!

I don't disagree, however, I was a child when Bork went down due to their manuverings.

In my memory it is Estrada, not Bork, that inspires a personalized sense of loss. This would be different for those of age to be affected by what happened to Bork. I do recall some of what Thomas went through, but in end he was confirmed.

Where is it that judges are now allowed to carry guns into the court room? I read it somewhere recently, and since that murder rampage in Atlanta, I can well understand the need.

If I were king, Scalia would be chief and Thomas would be number two and the rest would be gone! Maybe Rhenquist didn't really know what they were talking about? I find it hard to believe that he would have voted witht he liberals. I can understand when there is a jury to determine guilt or innocence, but sentnecing? That's BS!

The premise is that Byrd changed rules based on a simple majority, countering any argument that the Dems have now that the Republicans must have 60 votes just to change the rules. 2/3rds were present but it still only required 51 to change the rules then and that's all it should take now.
