Sun Tzu: "Build your enemies a golden bridge that takes them in the direction you wanted them to go in the first place. Do not force them to fight to the death."

This allows for defections, retrenchments and retreats on their part, and gives us our nominees. I bet we get all of them. And Bolton too.

What we don't get is to rub excrement in their faces. I'd like that, but it's not realistic 99% of the time in politics.

Here is my solution to this problem. If I am the President, I send the VP to the Senate and hold a meeting with McCain, Collins, Chafee, Graham, et. al. At that meeting the V.P. informs them that he would like them to immediately either fall in line or leave the party. I then tell those who refuse that the President is making it his JOB to ensure that they are out of the party. He will veto any legislation that is favorable to their state, he will actively and aggresively campaign against them, and he will do so with the able assistance of Carl Rove.

This deal is about two things.

One, getting the RINOs press, as 'moderate' republicans.

Two, getting the Rats out of trouble so they don't have to vote against nominees that are conservative AND minority.

The process that the GOP wanted to use was a rules change. I assume you know about that.

What this deal will do is ensure that the GOP doesn't get to try that rules change until the white nominees come up for a vote, denying the p.r. advantage to the GOP and handing it to the Rats.

What I suggest would basically force the RINOs and the Rats back to voting against the minorities. It would cripple this deal, because no matter how many RINOs or Rats cross the aisle, the GOP could still ensure a vote under the 60 required, an objection and ruling from the chair, and a vote on the record by the RINOs and Rats that neither of those groups want to end the filibuster and get these minority judges through (and thus campaign charges of racism and sexism can stick to them).

We don't lose, anyway, because the two groups have already said they'll vote FOR these nominees. So why NOT try it?

Mine don't gather dust, they go back with this message inside (instead of cash)

Dear Fellow Republicans……

It is with deep regret that I must decline to contribute further to a party that refuses to acknowledge that they are the majority. It is long past time to change the rules in the Senate which allows the minority party to filibuster judicial nominees and hold the process hostage with only 40 votes. Change the rules back to requiring only 51 votes to gain approval. We have been the majority now for 3 years and we are still acting like the minority.
Stand up and take command (that is the idea of winning elections) and I will resume my financial support of the Republican party.

Yours Truly ….. NRA1776

I am sure that something like this will happen tomorrow. There is no way that the White House can let this semi-mutiny go unanswered.

RINOs better wtach out!

Hell, I think that should have happened already. Better to kick the snake on the crown of the road than leave it hiding in the grass. How many flat snakes have you seen in the middle of the road? I've never seen any hiding in the grass.

Agreed that party-bolting ala Laz isn't the appropriate response to the situation yet. But it's coming if the rules don't change.

"They control the Democratic party, but so far have only penetrated slightly into the Republicans. That slight pentration was enough to win this time. But we can still save the party.

Bull! "slightly =75%"!

There is absolutely NO hope of recovering the Constitutional Republic via the republocrats. They are justed as dedicated to socialism as the demorats.

In any case, the old marxist({:-)) saying applies here: "If you can get the head in, you can get it all in."

The solution is for the nominees thrown over board to immediately withdraw. Then President Bush should renominate them. The 14 have promise not to filibuster any Bush appeals court nominees for the rest of the term and thus would have to break the agreement to filibuster the then newly nominated appeals Court Judges.

Have you seen the text of the deal? I don't think it is what you think it is. This is the text of the deal as I understand it:

MEMORANDUM OF UNDERSTANDING ON JUDICIAL NOMINATIONS

We respect the diligent, conscientious efforts, to date, rendered to the Senate by Majority Leader Frist and Democratic Leader Reid. This memorandum confirms an understanding among the signatories, based upon mutual trust and confidence, related to pending and future judicial nominations in the 109th Congress.

This memorandum is in two parts. Part I relates to the currently pending judicial nominees; Part II relates to subsequent individual nominations to be made by the President and to be acted upon by the Senate’s Judiciary Committee.

We have agreed to the following:

Part I: Commitments on Pending Judicial Nominations
A. Votes for Certain Nominees. We will vote to invoke cloture on the following judicial nominees: Janice Rogers Brown (D.C. Circuit), William Pryor (11th Circuit), and Priscilla Owen (5th Circuit).
B. Status of Other Nominees. Signatories make no commitment to vote for or against cloture on the following judicial nominees: William Myers (9th Circuit) and Henry Saad (6th Circuit).

Part II: Commitments for Future Nominations
A. Future Nominations. Signatories will exercise their responsibilities under the Advice and Consent Clause of the United States Constitution in good faith. Nominees should only be filibustered under extraordinary circumstances, and each signatory must use his or her own discretion and judgment in determining whether such circumstances exist.
B. Rules Changes. In light of the spirit and continuing commitments made in this agreement, we commit to oppose the rules changes in the 109th Congress, which we understand to be any amendment to or interpretation of the Rules of the Senate that would force a vote on a judicial nomination by means other than unanimous consent or Rule XXII.

We believe that, under Article II, Section 2, of the United States Constitution, the word “Advice” speaks to consultation between the Senate and the President with regard to the use of the President’s power to make nominations. We encourage the Executive branch of government to consult with members of the Senate, both Democratic and Republican, prior to submitting a judicial nomination to the Senate for consideration.

Such a return to the early practices of our government may well serve to reduce the rancor that unfortunately accompanies the advice and consent process in the Senate.

We firmly believe this agreement is consistent with the traditions of the United States Senate that we as Senators seek to uphold.

"Frist never had the votes for the Nuke, ever. McCain is a snake but he gets the job done.Frist,Santorum, and Allen are worthless."

As a Pennsylvanian, I am offended that you left out Arlen Specter in a discussion of snakes and the appointment of judges. I resent the implication that McCain is a bigger snake than Arlen.

As far as I could see, George Allen from Virginia was not with the group of deserters.

If the rats cave and give Owens and Brown, or any number of judges an up and down vote, but reserve the filibuster, I don't see a problem unless Frist loses his option to use it at a later date. I don't believe he does, I think his objection stands until the next session of Congress.

The real danger is if 6 repubs decided at a later date to vote with the rats instead of their party. But that amounts to political suicide for them.

I don't see any way the rats win this, even if the filibuster is not ruled out at this time. Frankly though, I'd feel better if it was, because I don't want to take any chances, especially on a Supreme Court appointment.
