Replacing the judge is more important than naming the Chief Justice, although you can do both at once.

Interesting question. I wonder if there's ever been a recess appointment of a SCOTUS justice.

Presumably, it would not be Gonzales in that he has been attorney general but for five months. But again, it would not surprise me at all if the choice is the "moderate" Gonzales.

I would love to see The President nominate Scalia or Thomas to the Chief Justice position and maybe Judge Janice Rogers Brown to the Supremes. After all, the Senate just voted to confirm her, so what could possibly be the problem?

I agree. Scalia or Thomas will probably get promoted, and someone else will be nominated to take their former place as associate justice.
