Did Ruth Bader Ginsberg ever work in the government? Wasn't she always in private practice (working for the ACLU)? How could the Senate possibly evaluate her professional work without seeing everything she had written to her clients?

So the idea that is actually being put forward is that the client does not have attorney-client privilege when the client is a Republican administration.

The Kerry 180 is still under lock and key. He probably had to swear an oath to Jimmah Cahtah never to let it see the light of day, after Jimmah "massaged" it.

Much as I hate to say this, there's no comparison between Kerry's signing his SF 180 and the release of Robert's writings, nor should they be mentioned in the same breath. It only sets up a straw man argument that our side can only lose.

Kerry's SF 180 concerns records which are his and his alone to release. To whom and under what circumstances he releases those records are his personal matter. The only reason that conservatives want them is because, as a candidate for national office, he should release them in order that people know for whom they are voting.

On the other hand, Robert's writings are protected by attorney client privilege. Release of those writing has to be done with the consent of the client, not Roberts. He does not have the right to released them.

Kerry's releasing his records is his decision, Roberts records are the "property" of the client and are not his to release.

Although Kerry must have a large set of stones to get in front of this issue, this is a bad comparison to make. Just my opinion.
