Two Illegal Immigrants Win Arizona Ranch in Court Fight

By ANDREW POLLACK Published: August 19, 2005 DOUGLAS, Ariz., Aug. 18 - Spent shells litter the ground at what is left of the firing range, and camouflage outfits still hang in a storeroom. Just a few months ago, this ranch was known as Camp Thunderbird, the headquarters of a paramilitary group that promised to use force to keep illegal immigrants from sneaking across the border with Mexico.

Now, in a turnabout, the 70-acre property about two miles from the border is being given to two immigrants whom the group caught trying to enter the United States illegally.

The land transfer is being made to satisfy judgments in a lawsuit in which the immigrants had said that Casey Nethercott, the owner of the ranch and a former leader of the vigilante group Ranch Rescue, had harmed them.

"Certainly it's poetic justice that these undocumented workers own this land," said Morris S. Dees Jr., co-founder and chief trial counsel of the Southern Poverty Law Center in Montgomery, Ala., which represented the immigrants in their lawsuit.

Mr. Dees said the loss of the ranch would "send a pretty important message to those who come to the border to use violence."

Looking up the articles on Google, they were found not guilty on the pistol whiping charge as the illegals kept changing their story.

There's a different standard of proof in civil trials. OJ was found not guilty, but he still lost in the civil trial.

And, the defendants settled here, so they probably felt that the plaintiffs had a good case.

The defendants settled in the civil trial. It never got to a jury decision.

That'll teach me to read only part of an article.

1. We need the judge's name and info. 2. We need to find out what it will take to get an appeal going.

Nethercutt settled the case, so (a) the judge had nothing to do with the decision, and (b) he can't appeal.

Seriously now, Bird. Can you respond rationally to any of the points I've made on this thread? For example: What do you propose to do about the Americans who are paying the illegals to cross the border? Do you really support the idea, as espoused by some on this thread, that it is permissible to commit crimes such as assault and murder against illegal aliens because they're "breaking the law by crossing the border?" Well?

If you mean those who hire illegals once they get here because they offer cheap labor, I would say the best way to reprimand those employers is to fine them heavily. Make it no longer profitable to employ illegals in the first place. If you're referring to some kind of organized network of Americans working with the Mexicans to transport them here like some sort of underground railroad, then I say lock 'em up and throw away the key. If such a network exists, then they're worse than the coyotes.

I understand that these illegals are coming here for a better life for their families, and I respect their desire to rise above their current station in life. What I don't respect is why they have to come here illegally, without going through the proper channels to become naturalized. They're doing it because they can get away with it, simple as that. I wouldn't get a driver's license, report to jury duty, or pay taxes if I could get away with it. That's why enforcement is important. An example must be made of those who don't follow the rules. Otherwise it's chaos.

I don't condone violence against these coyotes, but you must understand that a backlash is naturally going to occur when Americans feel their voices are not being heard and their interests are being superseded by the interests of illegals.

Or did the settle because they just didn't have the cash to continue fighting? A $1.3 million judgement and further pending actions isn't an easy hurdle to overcome.

Or higher priced hired guns. They only went after those with assets.

This was nothing but a money grab by the SPLC who will undoubtedly end up with the the majority of the proceeds from this properties sale.

Fortunately, the resident FR quisling contingent is a tiny little collection of illegal alien enthusiasts whose whining squeeks continue to grow fainter and fainter.

The quislings have lost the battle and are now beginning to realize they are about to lose the war.

All true. And the reasons why they're getting away with it is because Americans not only let them get away with it, but actively encourage it. Do you seriously think these folks would otherwise be headed north in such large numbers? This is not a "Mexican" problem, it's an American one.

If the backlash includes assault and murder, then the backlash should be stopped. Simple as that.

It's nice to see that you're capable of engaging in a rational conversation, and not just mindless name-calling. It might even interest you to know that we probably agree on the topic of illegal immigration more than we disagree (which I guess makes you a liberal-smelling RINO, too).

The problem with threads like this is that there are a lot of folks who are trying to fight this battle on the supply side, rather than the demand side. Getting control of the demand side is the real issue for me. I don't care to speculate on what's driving a lot of folks who are upset about the supply side of the issue.

Er... it is the Governments job to control the border. Despite whatever incentives may exist for illegals to come here. If the Government isn't doing that job, then maybe we should fire them...

That's quite true. But the question remains: if Americans are the ones providing the incentive, shouldn't the government be paying a bit of attention to the demand side? And if the Government is part of the "incentive" package -- as is surely the case in places like California -- doesn't it likewise make sense to focus your energies on changing the government's direction?

The illegals are coming here for the money. That's just a plain fact. Dry up the money, and the illegal immigration problem just got a whole lot easier to deal with.

For most but not for all. Some have much more nefarious thoughts in mind. Close the damned border. We have LEGAL immigration laws and temporary work visas available.
