LOS ANGELES - A 15-year-old burglary suspect died Wednesday, a day after being shot by a woman who told police she returned to her South Los Angeles home to confront a tire iron-wielding boy in her house.
The shooting took place about 8:30 a.m. Tuesday when Mary Ann Talley, 59, returned to her home after her daily walk, police said in a statement. When Talley entered her home, a young burglar confronted her with a tire iron and she shot him with a handgun she keeps for protection.
The boy was taken to a hospital where he died Wednesday, said Officer Jason Lee, a police spokesman.
The boy's identity was not released.
Talley was not injured in the incident.
The Los Angeles County district attorney's office was investigating to determine if any charges should be filed, Lee said.

Hell yes charges should be filed: parental neglect, educational neglect, and if the perp were still alive charges ought to be filed against his sorry @$$ for breaking and entering, armed robbery, assault with a deadly weapon...

I was feeling pretty proud of being from Baton Rouge after reading the title. Then I read on and realized South LA meant Los Angeles and not South Louisiana.

In 1976, my wife's cousin, then just 21 years old, shot and killed a would-be rapist who broke into her apartment in Houston. The 300 lb intruder kicked the door in at 3AM, confronted her with his intentions, and declared, "You wouldn't shoot me, you little ****." Those were his last words, she hit him twice, in the neck and above the right eye, with a .45 auto. The grand jury hearing was strictly routine, required by law after all fatal shootings, and resulted in a quick no-bill.
I wonder how many California gun laws Mrs. Talley broke that morning.
Look at the way the story is worded...

They word it so it makes her look like SHE came back to shoot him... Not that she happened to walk in on him and startled she probably grabbed for her gun she has... But, instead she left to get the gun and "returned to confront him"....

I would imagine that the woman who shot the perp may be facing a civil lawsuit from the family (if he has one) of the little burglar. I can hear it now. His mother blubbering, "He was a good boy. He shouldn't have had to pay with his life for making a mistake. We miss him!".

Please. Filing charges against a woman for defending herself against a thug threatening her with a tire iron?
None, I believe. In CA you can carry concealed and loaded in your home. Also, the law says that if someone breaks into your home you are presumed to be in fear of your life and justified to use deadly force.
California has a "your home is your castle" doctrine. You have no duty to retreat in your own home.

Poorly worded, but then the second paragraph makes it very clear what happened. I can't imagine anybody would come away from this story thinking, "Gosh, that lady came in, found a burglar, left to locate a gun, and then came back and shot the burglar, who had conveniently waited around for her to return so he could be killed."
Let's be realistic.
