Another Outrage from Child Protection Services

Interested Parents,

Tuesday, October 18th at the Biltmore Hotel & Conference Center – 7:00 – 8:30pm, we are holding a meeting to inform, educate, and rally the public around the egregious abuse of power by the Santa Clara Social Services, Department of Children and Family Services (DCFS) – Child Protective Services (CPS) as they attempt to rip my family, and many others apart. The Biltmore is located just south of Montague Expressway, east of highway 101 at 2151 Laurelwood Rd, Santa.

At issue are three key points that will be of interest to you as a parent:

  1. Our rights as parents to raise and educate our children as we deem appropriate within the law, free from the harassment and abuse of Social Services,

  2. Our rights as adoptive parents / families to seek and utilize resources that will help solidify the bonds of attachment which are essential to a successful adoption, and

  3. The need for change in the policies of DFCS that will position them to embrace and support families rather than vilify parents and destroy families.

Synopsis of our Situation – The Johnson Family (my family) - is currently under siege by the Santa Clara Social Services, Department of Children and Family Services (DFCS) – Child Protective Services group (sometimes referred to as Emergency Response). The department’s intense interest in my family stems from an allegation of child abuse related to our oldest son who was adopted at birth, and who suffers from drug and alcohol abuse in-utero and a condition called Reactive Attachment Disorder (RAD). It is my understanding that the mother of a baby sitter made the report after talking with her daughter who has never met my adopted son, and only sat one time for my two younger children for one day in our home. The sitter observed inconsistencies the furnishing of my oldest son’s room and observed the smell of urine. On this basis this, the mother, who has never met any member of my family, or stepped foot in our home, or discussed the circumstances surrounding our son, reported us to the police as child abusers.

Because we are home schoolers, we initially consulted the HSLDA who advised us not to allow CPS into our home or to interview our children unsupervised. We were further advised to seek the services of a local attorney to ensure that our rights as parents were not violated as we work to clear our names related to the allegations of child abuse, which we did.

The DFCS, as a result of our refusal to allow them to interrogate our young children without supervision, together with the fact that we home school and therefore they are unable to gain access to our children without our permission (as is commonly done when children attend school outside of the home), went to court and swore out a Protective Custody Warrant to force themselves into our home, to have their way with our children, and to remove my oldest son into their protective custody. Today, my wife and children are in hiding to protect our family, in a location not even know to me, while I have been engaged in a very distressing and disruptive court battle in an effort to have the Protective Custody Warrant quashed, a request that was denied last Friday.

To date, no one at DFCS has been interested in understanding our unique parenting needs, the resources we have used and the third parties who can speak to quality of our parenting, and love that we have for of all of our children. Their action, based on our stance of “tell us what you are concerned about so we can give you reasonable access to our family to resolve them”, has been to take the child and ask questions later. They have leveraged the courts in this effort.

Since DFCS has no interest, nor apparent requirements to ascertain the facts before they have ripped our family apart, we’ve decided to share them with you. Perhaps when you speak out someone in the agency will finally listen to how they are about to destroy yet another family in an effort to “protect” a child that does not need protection and initiate policy based changes. This is why I urge you to come out Tuesday evening! This is a completely free event paid for out of my paycheck.

How about we unfund these unconstitutional Federally mandated organizations and go back to letting local law enforcement deal with these problems?

Fine with me. There needs to be some provisions for dealing with abusive parents, but I don't see why detective units dedicated to it who operate under normal criminal law can't take care of it.

What indications? All we know is a teenage girl alleged the abuse and the police found nothing. Did I miss something else?

Look, this is a message board, not a court of law, and: Babyitter says room smells like urine and is furnished weird. Dad, in his email, gives clintonian statment about room furnishing. Dad refuses access to CPS. Dad says kid is diagnosed with a syndrome that is so exceedingly rare that it is usually a quack diagnosis. Dad sends kids into hiding. Sorry, I understand that CPS operates in an unconstitutional manner, but it sill sounds like somewthing is wrong here (besides CPS)

This case: A 16 year-old babysitter that was in the house one time smelled urine and saw inconsistencies. in the boy's room. Inconsistencies could be anything. Perhaps the room was spotless yet the smell of urine was inconsistent with that. 

I understand all that, that CPS can be evil. But, in this case, it seems that they have good cause to be concerned.

The noose is all yours.

I pray a member of your family isn't falsely accused of child abuse. Because, when it happens, I guarantee your attitude toward them will change 180 degrees from where you are today.

I have a brother who today has custody of his 6 year old daughter even after NINE FALSE SEXUAL ABUSE charges made by his EX. My niece had to go through 3 genital exams and 9 interviews. Never substantiated but my niece spent almost 5 mos in foster care thanks to that &^@!$*'s allegations.

My other brother has a 6YO son with his X. X is remarried and had a baby in July. Baby tested positive for Meth. CPS took both kids and put them in foster care. No legal charges have been filed against mother or father (both of whom tested positive for Meth). My brother has been on a crusade since July 29th to get his kid. STILL CPS will not give him a reason as to why he can't have him. Hearing is Oct 26th.

Nazis is too nice a word for this agency.

The problem is that local law enforcement did a really bad job of dealing with these problems until there was a dead child.

A dead child, in my opinion, is a suboptimal outcome. If there is no mechanism to prevent it...well, when it happens, then public retribution must follow, and said retribution must be swift and merciless--on a par with shooting the parent right there in the courtroom, right after the verdict is read.

CPS basically acts as another arm of the law. There is no investigating they do that can't be done by police/detectives. "For the children" is BS. I'm not spouting liberal rhetoric when I say they prey on poor, uneducated people! They DO! Hello, isn't that what Democrats do BEST?

I support abolishing CPS. But you probably would not like my solution to the problem.

If a parent is convicted of inflicting death or grievous bodily harm on their child, the parent should be executed right there in the courtroom as soon as the jury finishes reading the verdict.

When the convicted parent is in reality innocent "you" have just killed the child's innocent parent. Suppose you, your spouse or one of your children whom were convicted by a jury and put to death yet in reality you or they were innocent? What about the child(ren) that must then grow up without the parent?

Except that police have traditionally done a pretty lousy job of it until there's a dead child and, hence, a murder investigation. Is that your standard for acceptable performance of the mission?

How about if we put CPS UNDER the directive of the police and make them take the same law/legal classes to hold their positions?

Another dead child killed by its parents? Oh really? How many of those are there? Five a year? Ten? How many were prevented by CPS? How many could have been?

Remember now, they don't ususally investigate the cases in ghettoes and barrios. Too dangerous.

By comparison, how many suicides, divorces, and broken families are there because CPS blew things out of proportion? How many kids couldn't go to college because the parents blew every dime defending themselves against the bureaucracy? Frankly, my money is on a net negative contribution.

In most jurisdictions, they already do take those classes.

Well, I can tell you from the hundreds of cases I've read, they don't follow them.

My brother's civil rights have been violated from day 1. If his X were to have died, he'd have custody. But noooooo...not when CPS is involved.

A friend of mine has an adopted attachment disordered child of a different race. Know what the little sociopath would do when they were at the mall and she did not buy him the things he wanted. He would begin screaming: Get away from me, you are not my mother! And she would then spend 24 hours with various police and social services types proving that she was the mother and he had emotional problems. She now carries pictures of her family with her at all times as well as his birth certificate. Just in case.

In this disorder the room is not usually a wreck. Instead, the door is removed from the hinges, and all furniture and items are removed from the room except for a mattress on the floor. Many of these children wet the bed and will not wear protection.

Well, the room did smell like urine. I have a hard time imainging how that could be the case.

Many kids bedwet. RAD kids are usually sleeping with a mattress on the floor often without bedding, their choice.

In the average city today? Maybe a couple dozen per year. We only hear about the JonBenet Ramseys and the tony uptown au pair murders, not the normal ones. It used to be a sizable chunk of the homicides we had in any year were likely to be parental homicides, and due to the circumstances of the cases, they were almost 100% unsolved.

If the child is dead, then the murder was not prevented.

A lot more get prevented now than there used to be.

I used to live in a ghetto. CPS can and does investigate cases there, and they are far more likely to take drastic action.

You typically don't hear about those cases because folks living in the ghetto don't usually send mass emails that are suspiciously free of verifiable fact and full of hyperbole, like this one.

Well, to hear some FReepers tell it, they've committed suicide half-a-dozen times because of CPS.

Longer ago than I care to admit, I was a cop. By the time we were involved, the child was dead. Frequently, we only found out about the murder because we accidentally found the body a year or so later, long after the parents had hastily bugged out of town. A lot of the "missing children" of that era were dead children we hadn't found yet.

Now, maybe you think that state of affairs was a good thing. I don't.
