FEINGOLD: At the judiciary committee hearing, uh, that I attended with seven constitutional scholars, I asked those who believe in this inherent power whether this inherent power would extend to assassinating American citizens --

RUSH: (scoffs)

FEINGOLD: -- and none of them could give me a colorable or credible answer that it would not.

RUSH: Oh-ho-ho-ho!

FEINGOLD: That's a dangerous doctrine, and that is the context that makes me think that censure is an appropriate -- and in fact measured -- response to this kind of an attempt at executive power.

FEINGOLD: It seems to me appropriate when the spin machines are out there and the people are using various language to come out and reiterate my reasons for doing this. Uh, I think that the press decided, uh, immediately that somehow this was a bad thing for Democrats and a good thing for conservatives. The facts don't bear it out. You don't have the polls to prove it, the way my colleagues are responding to me suggests to me they're thinking about this, that they feel that there has to be some accountability. So the instant decision about the what the story is actually I think is going to backfire on those who made up the story. I don't get the feeling that I had on Monday about this. Yes, people were concerned. I'm not getting...that.

I'm trying to find where these comments were made and, if possible, a full audio clip and transcrips of his statements in context.

I'm posting on a mixed board and they will never believe these quotes aren't made up if I post rushlimbaugh.com as my source.

If an American citizen takes up arms against his country, or engages in espionage against his country, aids and abets enemy agents, he should understand that we're looking for him, and we sincerely hope to find him.

So the last resort is to somehow say that the President has inherent authority to ignore the law of the United States of America, and that has the consequence that the President could even order the assassination of American citizens if that’s the law.

This is even from a LIBERAL site!

I am sure it is more convenient for the senator to debate with the small number of Republicans who claim the President can break any laws he wants to for national security instead of the more rational Republicans who point out there is no reason to believe the President broke the law in the first place.

Regarding your link, I love all the comments by Koh, Dean of Yale Law School. The reception the Supreme Court gave his filings in the Recruiters on Campus case by the Supreme Court should make any of his other legal opinions suspect. I would expect his opinions in the NSA surveillance situation to be equally devoid of legal reasoning.

Yep, I don't think there has ever been a bigger statement of independence from academia by the Court.

Anyone with Rush 24/7 has a copy of the comments, since Rush played them on his show. We all heard the comments, so you should now worry about not being believed.

Sometimes I think these openly irrational, inflammatory statements, which seem to be made more frequently, are a manifestation of a kind of X-files culture...a failure to reason resulting in irrationality and paranoia. Look how too many Americans are responding to natural disasters, 9-11, enemies like Iran and China, etc.

(Or, maybe its the result of TV, its frenetic, disjointed pace....causing a kind of cultural insanity.)
