The resolution places the full weight of the party of more than 5.3 million voters behind a ballot initiative to overturn California’s obsolete ban on the construction of new, safe, clean, and reliable nuclear power plants. The initiative is known as the California Energy Independence and Zero Carbon Dioxide Emission Electrical Generation Act of 2008.

The formal ballot title of the initiative was assigned last week by the Attorney General: “Nuclear Energy. Removal of Prohibitions on the Construction of Nuclear Power Plants.”

Realistically how will they get decent electrical power and fresh water... Nuclear power/desalinization... sometimes I wish some one would roll up some recycled news print and whack each of the anti’s on the head in California...

The 9th Circus Court will over rule the ballot initiative as ‘Unconstitutional’ if it passes for Kalifornicans to have more reliable and cheaper power as it discriminates against alternative energy lifestyles.

The 9th circuit would not rule on a State Initiative,n it would be appealed through the state court system. Don't North Karalinaholes go to skool?

Actually, 9th Ciruit can, does, and has ruled on State Initiatives if it is challenged on US Constitution grounds.

They tossed out California’s Prop 187 which would have denied public services to illegal aliens. It passed the voters by a large majority, but was challenged on the grounds that it violated the illegal’s Constitutional rights to free public education. Prop 187 was struck down by the 9th Circuit and illegals are still sucking money out of the California public school system as well as other public services 187 would have made them ineligible for.

Yeah, well read this one again and see if that's likely. If this is challenged it will be in state court.

They need money to get this on the ballot. No CA initiative in recent memory has gotten to the ballot without paid signature gatherers.

This is a perfect opportunity to put the Democrats on the spot on environmental protection and safe and reliable electrical power. France has had nuclear power plants in most of its cities for decades without any problems. The Dems admiration for Western Europe is selective.

Prop 187 was never tried in the 9th Circuit. An appeal was filed, but Gray Davis agreed to mediation... then rolled over dead withdrawing the appeal.

I stand corrected.

Still ... it WAS a federal judge that placed the restraining order which prevented 187 from being implemented. And it was waiting for review by the 9th Circuit when Gray Davis pulled it for mediation instead.

The original poster’s somewhat satirical comment that some loon could find some grounds for a federal court to void the vote of Californians on a ballot initiative to build more nuclear powerplants is not so farfetched. Say the never-ending Nevada dispute over Yucca Mountain as a waste repository. A Federal judge might maintain a moratorium on new nuke plants on the grounds that there is no place ready for the additional waste.
