Feminist 'Justice' at Duke by Stephen Baskerville (more by this author) Posted 10/18/2007 ET

The falsely-accused Duke University lacrosse players are suing the city of Durham and prosecutor Michael Nifong for malicious prosecution, claiming “one of the most chilling episodes of premeditated police, prosecutorial, and scientific misconduct in modern American history.” In fact, their ordeal was nothing out of the ordinary.

Few Americans realize how extensively our criminal justice system has been corrupted by leftist ideology. It has now reached the point where the criminals are prosecuting law-abiding citizens.

Conservatives who rightly decry judicial activism in constitutional law have trouble accepting the equally serious corruption of criminal justice. Understandably attached to principles of law and order, many fail to realize how complete is the perversion of our justice system and continue to presume guilt. Conservatives are correct that criminals often go free but fail to understand that this happens because of a politicized judiciary that criminalizes the innocent.

Hyping the racial factor has also allowed us to avoid the most serious implications of the Duke case. The far more powerful ideological force driving this and other miscarriages of justice is institutionalized feminism. There is little indication that white people are being systematically incarcerated on trumped-up accusations of non-existent crimes against blacks. This is precisely what is happening to men (and even some women), both white and black, accused of the “gender” crimes that feminists have turned into a political agenda.

Rape accusations have long been out of control. Almost daily, men are released after decades of incarceration because DNA tests prove they were wrongly convicted. But while DNA has righted some wrongs, the corruption is so systemic that hard evidence of innocence is no barrier to conviction. Even the Washington Post has documented how feminist crime lab technicians doctor evidence to frame men they know to be innocent.

Writers like William Anderson and Dorothy Rabinowitz have pointed out the parallel between the Duke case and earlier child abuse hysteria, where feminist prosecutors whipped up public invective against parents they knew to be innocent. Like rape, child abuse has been not simply sensationalized but politicized by social workers who are, in effect, plainclothes feminist police.

The witch hunts were carried into adulthood through “recovered memory therapy,” another fraud perpetrated largely by feminist perversion of the psychotherapy industry, where preposterous tales of childhood sex crimes were manufactured from a psychological theory. In Victims of Memory, Mark Pendergrast shows how the recovered memory hoax destroyed families, ruined lives, and sent innocent parents to prison.

But these are only the tip of the iceberg. They are dwarfed by “crimes” in which men are removed from their homes and incarcerated without any trial at all.

These are “domestic violence” accusations, where no evidence, formal charge, or trial are necessary for the plainly innocent to be hauled away in handcuffs. Defendants are passed by the thousands through mass processing centers that bear little resemblance to a court of law or receive summary punishment without media scrutiny. Patently false accusations are not only permitted but rewarded in divorce courts, largely because they are effective weapons in lucrative custody battles that are the bread and butter for venal judges and lawyers.

This is now so blatant that even the legal establishment has been forced to recognize it. “Michigan courts do not provide a fair, or impartial, tribunal for any domestic relations litigant,” according to Michigan Lawyers Weekly. “Instead, they customarily and regularly deprive litigants of due process of law.” It is now common knowledge that trumped-up abuse accusations are frequently used, and virtually never punished, in divorce and custody proceedings. Thomas Kasper describes in the Illinois Bar Journal how knowingly false accusations readily "become part of the gamesmanship of divorce.” Writing in the Rutgers Law Review, David Heleniak describes domestic abuse as “an area of law mired in intellectual dishonesty and injustice.” Heleniak identifies six separate denials of due process in one state statute, which he terms “a due process fiasco.” One judge was caught actually instructing his colleagues to violate the constitutional rights of male defendants: “Your job is not to become concerned about the constitutional rights of the man that you’re violating,” municipal court judge Richard Russell stated at a training seminar recorded by the New Jersey Law Journal: “Throw him out on the street.... They have declared domestic violence to be an evil in our society. So we don’t have to worry about the rights.”

As in the Duke case, the open politicization of scholarship by domestic violence advocates with an ideological agenda also passes without scrutiny. Domestic violence has become “a backwater of tautological pseudo-theory,” write Donald Dutton and Kenneth Corvo in the scholarly journal Aggression and Violent Behavior. “No other area of established social welfare, criminal justice, public health, or behavioral intervention has such weak evidence in support of mandated practice.”

Many were appalled that Duke faculty members should publicly demand that the lacrosse players confess – as if professors are prosecutors, judges, and jurors. Yet precisely this modus operandi has long characterized “women’s studies” programs, breading grounds of false accusations that have polluted the curricula of thousands of colleges and universities with political ideology masquerading as scholarship, turned students and faculty into police informers, and incited young women into believing that every personal hurt is a crime of “violence.” “If a woman did falsely accuse a man of rape,” opines one graduate of such programs, “she may have had reasons to.” A Vassar College assistant dean thinks false criminal accusations contribute to a man’s education: “I think it ideally initiates a process of self-exploration.” Such views have long been dismissed as extremist, but we see the fruits of them at Duke.

Seen in the larger context of feminist justice, the Duke case demonstrates that the corruption of the criminal justice system by political ideology may now be most direct danger to Americans’ freedom. Judicial abuse is a particularly insidious tyranny because it perverts the instruments of justice themselves.

This is where “social” justice has led us. Decades of pursuing this illusory, subjective, and politically defined “justice” have left Americans so incapable of distinguishing guilt from innocence that we are now inured to the most open injustice.

Stephen Baskerville, Ph.D., is assistant professor of government at Patrick Henry College and Earhart Fellow at the Howard Center for Family, Religion, and Society. His most recent book, Taken Into Custody: The War Against Fathers, Marriage, and the Family, has just been published by Cumberland House Publishing.

If this is true, these "technicians" need to be sentenced to the maximum term that the men they framed would have served, with NO possibility of early release.

Yep. DNA is not fool-proof either if lab techs decide to doctor evidence to make an innocent person look guilty. There are no safeguards to counter a malicious prosecutor or prevent corrupt techs from presenting contrived evidence in a court of law. We tend to believe the guardians of justice are impartial and have clean hands. The outcome of the DukeLax case has taught Americans they are as partial, venal and dirty as the other players in the system.

The "feminist Rule" is so insidious and used with little discretion by poorly taught judges who rule from the bench as to have left the “Rule of Law” MIA – the perfect example is that Ms. Clinton a not very good Senator is now running for the POTUS, not working as the senator she was elected to be, she can evade hard questions and dodge issues that don’t please her and never answer to the crimes she has committed or been charged; such is her power from the dumbed down justice in the US.….and such are the times we live in. Heaven Help Us.

Sometime back an article was posted about a Duke prof that was a white lesbian who lived in a lesbian community because she didn’t want to be around oppressive males. She later was forced to see herself as the oppressor because lesbian blacks were also in the community. The article was about her dilemma.

Does anyone remember this post (and how I could find it)?

When evidence and equality before the law are discarded, all there is left is arbitrary power by whichever faction has influence at a given time.

Once that is established, those who ushered it in for “good” reasons will be replaced by those who wield such power for blatantly evil intentions.

Throughout history, it’s a common pattern when Utopianism is put into practice; the idealists establish factional arbitrary power, then a band of thugs kick them out and take over. Then the bloodbath begins.

Mostly about the Duke case but Michigan’s gets a long paragraph. Your call on whether it is MIping worthy, of course.

Life imitates art, almost: This sounds like Dave Chappelle's skit about the blind black White Supremacist. When he discovered he was black, he divorced his wife because "he couldn't have a wife that's a n*gger-love", then he killed himself "so there'd be one less n*gger in the world".

We need to re-open many of those cases.

This is as chilling as anything else in the article. Here is a judge who could care less about his oath and takes the view that the evidence doesn't matter, the constitution doesn't matter, just throw the guy out on the street.

Sometimes, in the military, a series of events occurs and the military does a "stand down" so that the events can be studied and improvements can be made. Too bad there can't a "stand down" order on all these phony domestic violence cases to give the judges notice to make sure that truth is the goal, not punishing innocent people for the sake of feminist ideology.

Forget a stand down.....if this crap continues unabated, the end result will be wide scale violence when the victims of this injustice can tolerate it no longer.

I think it is a mistake to ascribe "good reasons" to those who usher in such foolish evils. They want power, too. They are just more hypocritical about it than the blatantly corrupt.

Frankly, I wish there was some way to ensure that NO ONE who wanted to exercise power over his fellow man was ever afforded the opportunity. But that's not the way the world works.

Only constant vigilance and stiff resistance will even slow the tyrants down.

The worst thing that has ever happened to this country has been the rise of militant hate-filled feminism.

Ann Coulter and others have opined, with tongue-slightly-in-cheek, that the slope to liberal degradation of the Constitution and to U.S. socialism took its severest tilt downward when women were given the vote. The election of wussy one-worlders and compassionate, quiche eaters can certainly be traced to the advent of the feminine influenced suffrage.

The counter argument to such a posit is that the Republic was equally doomed with the continued hierarchy of knuckle dragging Neanderthals.

You're right. Here's a short list off the top of my head that we can blame radical feminists for:

- rise in divorce rates, broken families, fatherless children
- children dumped in day care, psychologically damaged (most extreme examples: Dylan Klebold and Eric Harris)
- destruction of Robert Bork's nomination to the Supreme Court
- near destruction of Clarence Thomas's nomination to the Supreme Court
-use of Title IX to destroy college mens's sports teams
- attempted feminization of boys in public schools
- tens of millions of American children destroyed by abortion

In reading through it, I think MI gets a few sentences--this is some unclear writing:

“Michigan courts do not provide a fair, or impartial, tribunal for any domestic relations litigant,” according to Michigan Lawyers Weekly. “Instead, they customarily and regularly deprive litigants of due process of law.”

This is followed by an assertion attributed to nobody in particular (It is now common knowledge that trumped up abuse accusations...), which is then followed by statements from the Illinois Bar Journal and the Rutgers Law Review.

It's a very good read, just needs a little more in the way of cohesion and specifics.

Stephen Baskerville is certainly right about this. But it's not merely "feminism". The entire Western Left is corrupt. Its idealogy is based on mendacity, and this is the single greatest threat to Western Civilization and to the entire world.

The "new morality" of the Left is nothing more than immorality. Claims of "social justice" or "higher justice" are nothing more than camouflage for injustice.

The Left itself is nothing more than decadence, the sickness that destroys civilizations and has since history began.

Mendacity underlies it all.

The Duke lacrosse case ripped the camouflage from the mendacity of the Left and revealed for everyone to see its injustice, corruption, delusions, pretensions, false assumptions, cruelty, and contempt for truth. This is the Left. This is the decadence. This is what it is.

Unfortunately, millions of people lack the clarity, wisdom, and/or intelligence to see the Left and its allegations for what they are--and, of utmost importance, to see the mendacity that is their foundation and the basis of everything that they allege.

In simpler words, as Rush Limbaugh has observed, Leftists cannot be honest about what they believe or their intentions. This is because the entire Left is based on untruth and deception.

The revelation of the truth, as in the Duke lacrosse case, exposes the Left for exactly what it is.

It is truth--the light of truth cast on falsehood--that the Left fears most--and for very good reason.

My personal belief is that changing Politicians without changing the culture will not and has not worked. That Feminists disguised as Christians are infiltrating our Churches and Houses of Worships. They now own the Universities across the Land. A Radcliff Administrator is now President of Harvard and promoting the Radical Gender Feminist Agenda. The Media is in bed with Feminists. In fact the leading Female Broadcasters on TV are all Feminists. Part of the “Spin Sisters” selling Communism and Socialism one gulp at a time (Liberalism). This has been going on now for decades.

What is the result? Marriage is dying. Men have been declared by the US Government to be Violent Sexual Criminals under IMBRA. The Bill of Rights has been discarded to make Feminsts happy. We are funding jobs for 10,000 Feminists in the Department of Justice under House HR 3093.

Gays have just taken over the California School System. And intend to indoctrinate the school Children of the Nation, in the Joys of Oral Sex, Anal Sex, Fisting, and other fun recreational Activities. Information was handed out to Elementary School children at a wellness fair.

Have you seen the photos of the Folsom Street Fair? Coming soon to a School near you. Feminists are tightly allied with Gay and Queer Activists. Queer is no longer an insult but a term of pride amongst Gays.

We have become so egregious towards Fathers in Divorces. That an Underground Railroad has developed to assist American and Canadian Men to flee overseas and to create new identities. Men are literally voting with their feet.

This week Feminists in an obvious attempt to stop the erosion of interaction between the Genders. Put out a disinformation story about how Feminists make better Romantic Partners. Two hardcore Feminists put this out.

Makes you wonder what they were smoking when they came up with this piece of Advocacy Research.
