CINCINNATI -- A lawyer for the man accused of raping a University of Cincinnati student said the encounter could have been consensual because the woman has a history of sleepwalking.
Dexter Ford, 52, is charged with raping the 23-year-old woman early Thursday morning near Interstate 71 in Cincinnati.
Ford's lawyer, Jeff Adams, said prosecutors told him the woman takes prescription medication and has a sleepwalking condition, a fact that will likely be the core part of Ford's defense.

That a bleepin’ lawyer would even consider this as a way to get his piece of cra# client off says almost as much about the lawyer’s morals as it does his client’s.
The counter to that of course would be:
If she was sleepwalking, I would think that being raped would have caused her to wake up.
The article says she did not wake up during the act. There is more to this then meets the eye, or is given in this article.
I worked with a young woman who was sleeping with anything in pants. Her friends asked her how she wound up with such dirt bags and she never could recall the events.
Finally a doctor found that pettie mal (sp) seizures occurred when she drank alcohol. She had no idea she was accepting a proposition or any idea of what took place.
When she stopped drinking the problem stopped.

Oh my gosh that must have been so scary for her! Thank God a doctor helped her out.
There is an old joke there, but I won’t repeat it because this is no joke.
That guy should be convicted, in the least, for date rape. He has absolutely no morals.

OMG! This guys deserves to be under the jail.
It could be another Ambien case. One woman gained something like a 100 pounds raiding the fridge while asleep, and thought all the missing food must be attributable to her teenage sons. She promptly lost it when she stopped taking Ambien and her middle of the night kitchen runs stopped. Another person was damaging walls and injuring a spouse during rages while sleeping — also stopped as soon as the Ambien was stopped. It’s a very weird phenomenon, and false claims are obviously possible, but there have been enough real cases documented that it has to be considered.

Two passing motorists reported seeing Ford on top of a woman near a White Castle restaurant on Taft Road near I-71, and called police from their cell phones, Cincinnati police said.
When police arrived, the woman was still asleep, according to police reports. She was taken to University Hospital for treatment.
Hamilton County Municipal Judge Fanon Rucker said he also was told the victim sleepwalked through the encounter.
Rucker set bond for $500,000 and ordered Ford to be tested for sexually transmitted diseases. Ford told police he is HIV-positive, Rucker said.
During the past 15 years Ford, who is currently homeless, has served time in the Hamilton County jail and state prisons on charges including aggravated arson, breaking and entering, possession of illegal drug paraphernalia, theft and trespassing, court records showed.

So the guys HIV+, and the woman concented to sex in public and she was still asleep when the cops arrived??? This doesn’t pass the smell test..
sounds like attempted murder to me.....
The whole thing is bizarre and unfortunate, and could have been avoided if this career criminal had been kept in a cage where he belonged.
