Illegal aliens are NOT “subject to the jurisdictions thereof”

In Plyer v. Doe the SCOTUS ruled that illegal aliens are protected by the Constitution.

However, you believe that illegal aliens are not “subject to the jurisdictions thereof” then you must also accept that illegal aliens cannot be prosecuted for crimes committed while on U.S. soil.

I think the main reason they inserted "subject to the jurisdiction thereof" in the text of the 14th amendment is to exclude families of diplomats as well as "Indians not taxed" (who were not citizens of the US at that time). Since virtually anyone seeking to immigrate was allowed in (other than criminals, polygamists, anarchists, those with contagious diseases, and those likely to become a public burden), they had no inkling of what the situation would be like today.

The biggest factor in how politicians deal with this is that they are deathly afraid of being called racists (especially Republicans).

Did you think about what you just said?
Illegals ARE subject to the laws of this country or they could commit any crime they want and we could do nothing.
Just being on US soil does not qualify as subject to the juridiction.

Subject to the jurisdiction and subject to the laws are not the same.
Do you disagree with the article and other posts citing dicisions that support it?

You don’t have to convince me. I live in Los Angeles and have seen a tremendous transfermation over the past thirty years.
City after city now looks like Mexico.
Billboards in Spanish all over. Stores, restaurants, etc all in Spanish. Schools with ninety percent Hispanic.
Babies, babies, babies, everywhere.
Day laborers all over.
Spanish announcements in stores like Home Depot.
Etc, etc, etc.
It’s an invasion pure and simple albeit on a slow scale.

As for me, I am equally offended when US and non US citizens receive Welfare.

We can argue the merits of the 14th Amendment for days here on FR but that will not change how the SCOTUS has interpreted the 14th. Therefore, babies born here to illegal aliens will continue to be U.S. citizens, just like you and me, and illegal aliens will still be educated in our schools.

Now, in order to repeal the 14th one would need the agreement of 67 US Senators and 34 State Legislatures.

Neither or those will happen.

I think the amendment was misinterpreted at one point when it was not a significant problem and has grown way out of proportion since creating a problem.
It does not need a new amendment.
It just needs to be read correctly.
If you won’t see that then what can anyone say?

It really does not matter how you or I read the 14th but rather how it is read by the SCOTUS.

However, the reality of the situation is that both parties are pandering to the Hispanic Vote and thus neither party will move to take action to repeal the 14th.

That added up to 11,200 babies for which Medicaid kicked in $34.5 million to deliver these babies, the feds another $9.5 million and Dallas taxpayers tossed in $31.3 million. The average illegal patient is 25 years old and giving birth to her second anchor baby. We could also talk about California, but you get the point.

The REAL point is it has been going on for AT LEAST ten years. Soooo let's look at the real numbers over just the last ten years, not the 25 years they have been a problem.

112,000 kids. 345 million + 95 Million + 313 million in costs. Three Quarters of a BILLION and that is only ONE COUNTY

$753,000,000.00 to illegal alien babies from one county.

Then? Heck the anchor babies at Parkland are only the begining.

Then means ongoing hospital emergency room expenses for two decades because "they have no doctor." They just go to Parkland for whatever.

Then means subsidized daycare.

Then means free education for 13 - 14 years as most of them rent apartments and do not pay property tax.

And the folks that own houses around here wonder why their property taxes are through the roof.
