Calif. court: Homosexual rights trump religious freedom

The same California Supreme Court that created a "right" to homosexual "marriage" earlier this year has now ruled that the state may force healthcare professionals to provide services that support an immoral and physically dangerous lifestyle.

California's highest court was unanimous in its decision on Monday that Christian doctors may not refuse to perform artificial insemination for homosexual patients. (See "California court says no religious exemption for doctors") Attorney Brad Dacus, president of the Pacific Justice Institute (PJI), reacts to the ruling.

"This is a clear violation of the fundamental rights of individuals to live and practice their faith," he states bluntly. "Forcing doctors to have to choose between being a doctor and being a Christian in the State of California is an outrageous violation of the fundamental rights of every American to be able to practice their faith and not to have to leave their occupation because of it."

In the case in question, the Christian doctors refused to perform artificial insemination on a lesbian patient, but did refer her to another doctor who would perform the elective treatment. Dacus says that proves this suit was not about guaranteeing "healthcare" for homosexuals, but instead about punishing Christians for obeying God's Word.

"This is not about denying people services," the attorney argues. "This is, instead, about the 'thought police' attempting to censor Christian beliefs and Christian perspectives that don't agree with homosexuality. We're talking...about individuals being able to force doctors or other professionals to violate their faith in order to keep their job." And that, he adds, is a clear violation of the rights of individuals to be able to practice their expertise and, at the same time, not to have to deny their faith.

The PJI president says the ruling is quite broad and will apply to almost every profession in the state, meaning that Christian professionals and service providers -- childcare providers, for instance -- will be forced to provide services to homosexuals that support their immoral lifestyle and clearly violate biblical standards.

"For example, lawyers who are engaging in marriage and family law can now be forced to [execute] documents for homosexuals adopting children...," Dacus offers. "And individual with a wedding service, despite their Christian faith to the contrary, can now be forced to conduct wedding services and wedding preparations for lesbian or homosexual male couples."

Dacus says the case is certain to be appealed. "This just goes to show how critically important it is for us in the United States to have a Supreme Court that is not against those who practice the Christian faith but, instead, understands what the Constitution is about and [do] not engage in outrageous judicial activism," he says.

I imagine the real issue here was physicians refusing to treat individuals with AIDS.

Few people are aware that a lot of dentists and surgeons have been terrified of HIV for many years now. Some were infected. And this became a menace to public health as a whole because some who became infected continued to practice, even when they developed neurological degeneration due to AIDS. This is *not* something you want to have happen to a dentist or surgeon operating on you.

From the National Institute of Neurological Disorders and Stroke:

“The virus does not appear to directly invade nerve cells but it jeopardizes their health and function. The resulting inflammation may damage the brain and spinal cord and cause symptoms such as confusion and forgetfulness, behavioral changes, severe headaches, progressive weakness, loss of sensation in the arms and legs, and stroke.

“Cognitive motor impairment or damage to the peripheral nerves is also common. Research has shown that the HIV infection can significantly alter the size of certain brain structures involved in learning and information processing.

“Other nervous system complications that occur as a result of the disease or the drugs used to treat it include pain, seizures, shingles, spinal cord problems, lack of coordination, difficult or painful swallowing, anxiety disorder, depression, fever, vision loss, gait disorders, destruction of brain tissue, and coma. These symptoms may be mild in the early stages of AIDS but can become progressively severe.

In the United States , neurological complications are seen in more than 40 percent of adult patients with AIDS...”

You ought to repeat this to any teen that tells you he or she is considering becoming sexually active.

Trust me, malpractice lawyers are a conniving and malicious (code for money hungry) bunch and have taken verbal remarks all the way to multimillion-dollar settlements. Call a patient “fat” or “whiney” or suggest (gads), they give up some vice (drinking, smoking … yes, even illegal drug usage) and you could kiss you practice goodbye. ;-)

I can tell by the intelligent discourse on the thread that we got the homos on the run. However, I believe it was the policy of the two doctors to not do AI on any single patients. That included homos and heteros.

I agree with the doctor's. They are giving some thought and care to the act of helping bring another person in the world and requiring the patient to demonstrate the support of two parents. Best for the child.

That's where the court bombed.

so the lawyers are practicing medicine now... prolly the same ones that will sue you cause you DIDN'T tell your patient he needed to quit dope, booze, smoking etc before he had a heart attack, lung cancer, liver disease.

It says Congress can’t deny religious freedom. It doesn’t say anything about the courts.

Any teen is unlikely to become infected with HIV via sex than they are through intravenous drug use. And to be honest with them, there are far more common, serious warnings they need to be given about sex, both in general and specific to venereal diseases.

There is a frightening assembly of STDs that are relatively unknown to most children, whose common effects can be permanent, such as herpes and genital warts, lead to sterility like gonorrhea, can cause severe birth defects in their children, and can otherwise mess them up, like chlamydia, which can result in life threatening cervical cancer.

And that doesn’t even scratch the surface of unwanted pregnancy.

HIV is fairly low on the totem pole, unless children associate with some real trashy people. That they don’t associate with them, even holding their behavior in some degree of contempt, is a very good way for them to avoid a LOT of problems.

Two things....if we sit around and allow it to happen it’ll damn sure happen. It’s sad that Cesspoolifornication is too far gone. Good people have fought the good fight there, but it should be a lesson to people living in ALL states...a model if you will.

Would everyone in my home state of Georgia just say....”Oh well I’m just gonna move elsewhere and let the psychos have the place”?

HELL no! We’d FIGHT!

Another point, this insanity HAS to one day go to the SCOTUS, there’s got to be clarification to mindless liberals that Christians need NOT hide in private from them, or we’re disallowed from public view, or that our kids have to have rampant homosexuality rammed down their throats, as evidenced by THIS crap to forcibly removing crosses from town logos, Christmas trees removed from public view...etc. etc. etc.

godless liberals need to understand Christians won’t be pushed around anymore and our culture and heritage will no longer be dismantled before our eyes!

So if you stay home on McCain it very well could be that it’ll come back to haunt you in the future because the SCOTUS might be short one conservative vote from running you off your own land!

Yes, Texas is one of those places. I also have lived in CA for awhile and found the people and land great buy the leadership and taxes poor.
