Obama and DNC served today concerning lawsuit questioning his qualifications to be President

I received the following email from a Philadelphia attorney who has filed a lawsuit against the Democratic National Committee and Senator Obama questioning his qualification to be President.

I asked Phil if I contributed to assure me none of the moneys collected would be used for political purposes.

Hi Bill,

No, none of the proceeds will be used to support any party. The proceeds donated will strictly be used for this litigation. Legal litigation is extremely expensive, especially when you require Expert testimony, which I am anticipating.

In addition, I just received confirmation that the DNC and Senator Obama were in fact served today, 09/04/2008. The DNC was served at noon and Senator Obama was served at 1:00 p.m. All Defendants have now been served so the case can proceed.

Thank you for your email. Please keep up the great job and continue spreading the word. Together we can make a difference.

Yes. The motion to restrain Obama was denied by the court, but the case goes on.

Can the courts compel Obama to produce records proving his qualifications?

Do you have a job?

Did you need to show that you were legally in the country and authorized to work here?

Should the standards for the most important job in the country be lower than the requirements for dish washer?

Further, you would think that somewhere in this whole process that that documentation would be filed with somebody. FEC maybe?

The FEC would only get involved if federal matching funds were being used by the Obama campaign.

Obama has refused matching funds.

Think about that for a moment.

A democrat is refusing taxpayer funds.

Why?

I'm not a lawyer but I did stay in a ... oh never mind.

Here is the order in Hollander v. McCain dismissing a similar suit against McCain. In this order the court set out the threshold a plaintiff would need to meet to have standing. Read the order if you want to know why Mr. Berg doesn't have standing.

It seems as if Defendants can easily stall this thing out until Election Day. If he wins the presidency, it's hard for the Plaintiff to prove that Obama was born outside the US and thus not a natural born citizen. He would have to get a birth record from Kenya (if were in fact born there) and there's no way that Kenyan officials can be compelled to comply with a subpoena from a US court. Ditto for Indonesia regarding an Indonesian passport he is purported to have obtained at age 21.

If he loses the presidential race, Berg can either drop the suit entirely or possibly seek to amend the suit in an attempt to remove Obama from the Senate - if he can somehow document that Obama was not a US citizen at all at the time of his election in 2004.

You are confused. The lawsuit NEVER was denied, and they have now been served for the lawsuit. Outside of the lawsuit was a MOTION to STOP Obama from being able to accept the nomination. That motion was denied and they were able to go ahead with their convention.

Mark Shields does commentary on PBS as the designated Democrat. So it's not surprising that he panned McCain's speech.

He has always been paired up with a discussion partner porported to be a Republican, to supposedly give two opposing sides to a political story. The so-called Republicans he has partnered with over the years include David Gergen, Paul Gigot, and David Brooks. Gergen worked in the Clinton White House and Brooks (now Shields' opposite on PBS) works for the New York Slimes. So those two are RINOS at best. Gigot is probably a real Republican of sorts, but kind of a "moderate" currently employed primarily by the Wall Street Journal.

Is citizenship required for Congress?

Yes! But one need not be a "natural born citizen." Senators must be citizens for at least nine years prior to their service, while House members must be citizens for at least seven years. That's in the Constitution.

Innocent until proven guilty only applies in the criminal context. This is not a criminal case, i.e. it is not the state against a person, but it is a civil case, i.e. person versus person.

This is a long thread, I didn’t read it all. I usually try to. So if this a repeat question, forgive me..it’s late.

Is this for real? I thought I read here last week that the judge threw it out?
