Berg Filed an Answer Sept. 29th, 2008

(Lafayette Hill, Pennsylvania – 09/29/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he filed his Opposition and Brief to Obama and Democratic National Committee [DNC] Joint Motion to Dismiss in the case of Berg v. Obama, No. 08-cv-04083.

Berg feels confident that he has “Standing” and the Court will allow the case to go forward. Our response was due in 14 days, but the Court requested our answer by Monday, September 29, 2008 and we complied. In our response we set forth sufficient reasons that I have “Standing” to bring this lawsuit. Furthermore, I set forth additional reasons that indicate Obama does not meet the qualifications for President of the United States and Obama should be removed from the ballot and held accountable.

Our website obamacrimes.com has received 17.1 + million hits. We are urging all to spread the word of our website – and forward to your local newspapers and radio and TV stations. Berg again stressed his position regarding the urgency of this case as, “we” the people, are heading to a “Constitutional Crisis” if this case is not resolved forthwith.

Berg claims that Obama may have been adopted by his mom's 2nd husband and is in fact Indonesian, legally, and not eligible to be president. The post is in the comment section from "Anne" written on September 28th. "I know a "top" person in the MSM quite well. I was very fortunate to catch her at a party and discuss this (the Berg lawsuit) for a few minutes (I asked about the citizenship angle). A little alcohol loosens the tongue. "we're hoping Obama wins and then we'll haul in the ratings ten times better than the Clinton affair. There's a lot more out there than you know, and whether Obama wins or not, you will definitely be shocked at the aftermath. At the moment, I see nothing, I say nothing, and I know NOTHING. But really, I do know that our investigators have a s___load of evidence that's probably gonna put this guy in prison."

Barack Hussein Obama has gotten where he is today by disqualifying the opposition. It would be ironic, if he were disqualified now. That would be justice.

Can you imagine if this eligibility question all comes home to roost AFTER the election, with Obama taking the White House and then being found to NOT be a "natural born" citizen in accordance with Constitutional requirements? Hello, President Biden??

Huh. If Obama would be found ineligible after the fact, would his choice of running mate even still count? I can't imagine how Congress and the Supreme Court would begin to sort out that kind of mess.

That said, I still believe with all my heart that this nation has not swirled far enough down the liberal socialist toilet to elect a crack-smoking homosexual Muslim street thug from Chicago as President of the United States. My feeling is that this eligiblity question will be rendered moot.

Standing means that the plaintiff has suffered real, tangible, measurable damage due to the fraud, unrelated to the costs of bringing the lawsuit, and I don’t think Berg can demonstrate this.

Berg addresses the argument he lacks standings saying that the failure of the Federal Election Commission and the DNC to investigate Barack Obama and his campaign, which has fraudulently taken in more than $400 million all the while knowing that he cannot serve as president, runs afoul of 5 USC §702, which states, in relevant part, that "[a] person suffering legal wrong because of agency action, or adversely affected or aggrieved by agency action within the meaning of a relevant statute, is entitled to judicial review thereof."

I am not opposed to what Berg is doing, nor do I dispute that he may have good grounds for his suit. I just don’t see it coming to fruition in any way that will make a difference for Conservatives. The lawsuit won’t be resolved until long after the election and the electoral college meeting and certification. If he won the election and Berg is right, then Biden becomes president. If he loses the election, the court would likely rule the case moot or barring that and Berg wins, Obama would find a way to be judgment-proof. At any rate, whatever Berg might achieve would be tied up in court long after the damage is done. I don’t fault Berg’s intentions or his right to try to fix things. I just know how these things usually work and I suspect Berg will be exhausted long before Obama gives him anything.

Yes, it would make sense and, with one debate over, it would seem inconcievable that these two could have colluded to pull a switch at this late date.

Hillary was running for president, not democrat nominee which was her biggest mistake. Obama stayed true to the hard left while she drifted center, costing her much support (loyal, that is). Do you remember when she made that awkward offer to BO to run as her VP? His response was 'why, when I'm leading?'. The media got into his corner and it was over for Hillary.

After this dissing I can't help feeling the Clinton's vowed to take this uppity neophyte down. Teleprompter Guy was being prepped for '12 or '16- not a run in '08, this was to be Hillary's.

If Barry's citizenship is doubtful, it could be just the crack she needs to get her foot back in the door. Benefits to Hillary: she rides in on a white horse to save the party, Barry catches the rubber-tipped spears thrown by the media 'til she arrives- sparing her (and us) from the hysterical cackling and other negatives unique to Hill.

I sort of think they had such a plan that went awry when BO became too full of himself. They might be able to go with Plan A in spite of this. If this happens, I won't be surprised. Nothing about the powermad Clintons surprises. The biggest problem for BO will be having to go home each night to a woman who is unproud of her country again.
