Under "Factual Allegations", Berg claims, "There is a Canadian Birth Certificate posted on the Internet in the name of Barack Hussein Obama, Jr.; however, the date of birth shows to be August 23, 1961.".

Yes, the birth certificate signed by Dudley Dooright. This case does have some major holes in it.
But I keep coming back to the main question, why doesn’t Obama just produce his birth certificate?
IMHO, there is only one way the plaintiff’s case can succeed both legally and in terms of media attention, and it seems quite far-fetched: if McCain’s campaign joins the case as a plaintiff!
Especially since he claimed in one his books that he’s seen it, handled it in his grandmother’s attic, along with shot records, etc.

Just my opinion of course, but ....
The upshot is that there is a process, which was recently described in the Robinson (Alan Keyes) case against McCain in California (http://docs.justia.com/cases/federal/district-courts/california/candce/3:2008cv03836/206145/39/0.pdf)
One of the millions of campaign contributors would have to bring the lawsuit. Unless Berg is one of them and an innocent contributor—not just one who contributed solely to bring the lawsuit—then he has no standing to pursue the suit. Standing means that the plaintiff has suffered real, tangible, measurable damage due to the fraud, unrelated to the costs of bringing the lawsuit, and I don’t think Berg can demonstrate this. Millions could, absolutely, but they would have to bring a separate lawsuit against both Obama and the DNC. That doesn’t help Berg. Now if Obama wins and it comes out that he is disqualified, perhaps McCain and/or the RNC could make a claim but I don’t think it helps the presidential succession.
Thats why we have an electoral college, so they say.
To prevent these kinds of things.

You may find yourself asking, what in the hell is BR549? Well, before it was a Country & Western music band, BR549 was an acronym used in the seventies show HEE HAW. Filmed at Opryland USA in Nashville, the show was hosted by Buck Owens & Roy Clark and featured C&W music, slapstick humor and an appeal to those of us who lived and grew up country USA. (B.F. Egypt for those of you who know what that means.) Hee haw was full of wit, humor and good, clean fun. HEE HAW is the literal sound a mule makes when it brays.
One of the characters in the show was Junior, played by Junior Samples. Junior ran a used car sales business and always tried to sell junked out cars. He would hold up signs or tell folks that his phone number was BR549. I can still remember laying in front of the wooden-console TV laughing at this. I couldnt have been more than 4 years old, but I can remember the joy it used to bring me even today. Hee Haw became a ritual of mine; lying in front of the TV dressed in one of my dads over-sized T shirts, giggling the night away. I dont think Ive ever not had the knee-jerk-reply to yell out BR549 when someone asks, whats the number? for something.

That “Supposedly” is a big word and an even bigger assumption. Electors are politicians or wanna-be politicians and their minions. Dem electors are not going to vote for a Republican president.
Meant to add, it is as easy to string the lawsuit out to late January as it is to early November. The Berg won’t make a difference in this election, at least not enough to put McCain into office if he loses the election.
Then they say hello to the Supreme Court of the United States, it will order how the votes are to be cast.

I am admittedly not up on electoral college rules but I seem to recall discussiom about four years ago on the matter of whether electors are bound to vote according to how their states voted or whether they were free agents who could vote as they wanted. Of course, if they assumed free agent status, the states could sue them and I imagine that would end up in court but I’m not sure anyone else would have the right to sue the electors besides their state governments. When it comes to the election of the president, we are not a strict democracy.

The electoral college exists to prevent problems such as the one in question, having a treasonous president, etc.
The college could debate and hammer out the issue of not natural born, and their vote could also be reviewed by the Supreme COurt.
If the electoral college is interpreting constitutional law, then, definitely the Supreme Court would have the power to review that interpretation. I was thinking in terms of challenges to individual electoral votes by parties other than the states. Thanks for the information.
