Sequoia Voting Systems on Constitutionality of Electronic Voting in New Jersey

{SNIP} This lawsuit alleges that the voting machines used for years in the majority of New Jersey counties – Sequoia’s AVC Advantages - are inaccurate, insecure, and unreliable – and thus unconstitutional for use in New Jersey. Sequoia categorically denies this allegation and has provided material to the contrary.

“Throughout our report response, we show how simple, established, and previously used accuracy and security protections - removed from the Advantages studied in the report published by the plaintiffs - make the items in their report next to impossible,” said Edwin Smith, Vice President of Compliance and Fulfillment for Sequoia Voting Systems.

“In fact, many of the scenarios painted by plaintiffs depend on the existence of crooked, malicious, and corrupt pollworkers, while the success of some scenarios depends on both corrupt pollworkers and inattentive voters, ” continued Smith.

“These two simple, established protections, as well as keeping the election computers off the Internet, render the attacks discussed in the plaintiffs’ report far less sensational - and more importantly - far, far less likely to succeed before they are stopped, or at minimum, detected,” said Smith.

“Tampering with voting machines is a State and Federal crime with both fines and prison time as part of the sentence. All of these items need to be taken into consideration when examining any voting equipment – electronic or paper based - because election security is all about the people, the processes and the voting technology, not just the voting technology in an isolated, sterile classroom environment with unfettered access,” added Smith.

That's true of any voting system. The phrase "stuffing the ballot box" didn't come out of thin air.

A good system should be constructed in such a way that if any poll worker in a precinct is honest, that precinct's votes will either be honest or will be exposed as dishonest. Of course, since Queen Gregoire (Washington state) has demonstrated that it doesn't matter if a vote is proven to be dishonest, I'm not sure what possible remedy could exist.
