Constitutional crisis looming over Obama's birth location

The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.

The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.

WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.

The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

When everything originally came out, I was on the "Shut up about it already" bandwagon, because I though that the lawsuits made conservatives look like a bunch of kooks. Frankly, I thought that it was a rope-a-dope by Obama. Since the same people talking up Ayers, Resko, Acorn, etc were also touting the BC, I figured that Obama would pull a copy of the BC out about a week before the election and say "Look, here's the Cert. Your charges on it were BS, and everything else is too!" Game over.

The fact that he HASN'T done anything, and in fact would rather pay lawyers rather than produce the document, makes me suspicious. I *still* think that there's nothing particularly nefarious on the BC, there's just something that's personally embarassing to 0. I saw on a previous thread, some speculation that his real father was Cuban. Interesting, I thought. Kind of hard to run as "The First Black President" when you're not black. Doesn't change my mind about him one bit. Doesn't change any questions about his eligibility either (father a Cuban National, rather than a Kenyan national). It DOES, however, make him a whole lot less electable. :-)

A BILL
To clarify the law and ensure that children born to United States citizens while serving overseas in the military are eligible to become President.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
This Act may be cited as the `Children of Military Families Natural Born Citizen Act’.

SEC. 2. DEFINITION OF `NATURAL BORN CITIZEN’.
Congress finds and declares that the term `natural born Citizen’ in article II, section 1, clause 5 of the Constitution of the United States shall include: `Any person born to any citizen of the United States while serving in the active or reserve components of the United States Armed Forces’.

You have to chose your citizenship at age 18. There is no indication that he ever did this. And there must be something on the birth certificate, or he wouldn’t be hiding it.

If he’s ordered to show it by the court, the Executive Branch has nothing to do with it. The main question, however much credit you want to give him, is why doesn’t he simply show it? Why the need to be forced to do so in the first place?

And Repubs let us down bigtime with McCain who did everything he could to lose, except for Sarah Palin—made a flying trip to DC for bailout crisis, then voted for it. The last straw. I have not considered myself a Republican for about 5 years altho voting for them. Never again—there’s nothing left anyway. The GOP is merging into the Demon party and both are trying to drag and kick us into the New World Order. Global order—even as we type!!!

The part about the Dems urging that naturalized citizens be allowed to be president is way back on this thread, I believe.

When McCain was challenged as to his eligibility, he produced his birth certificate, all the information relating to his parents and place of birth, etc. At that point, the Dems (or the Senate committee looking into this) “declared” him eligible, something they had no control over in any case; but at the same time, they tried to slip a clause into the bill opening the Presidency to naturalized citizens. This was spotted by the GOP Senators and taken out. It would have been a moot point anyway, since they would have had to amend the Constitution, something beyond the power of Congress acting by itself, but it might have given them some kind of flimsy legal precedent.

I’ll try to find the post - IIRC, I responded to it.

His post contains all the details on the Dems’ attempt to legitimize naturalized citizens for the Presidency. As arrogantsob says, it’s like the dog that didn’t bark (a reference to a famous Sherlock Holmes story).

Meh, there's no doubt in my mind that he's a con artist. I just believe in Occam's Razor, that's all.

Occam's Razor = The simplest explantion is generally the correct one. :-)

For instance, when John Kerry wouldn't release his military records, there was all sorts of conspiracies floated here on FR. The final reason turned out to be that the documents showed he scored lower in college than Pres. Bush. Hard to take the high road as "The Smart One", when your grades are lower. Occam's razor. No earthshattering revelations came out of the documents, just a marginally embarrassing tidbit.

Thomas is pretty easy to use, although I've seen state legislative sites that are better. I wish more people used it -- Congress needs the scrutiny.

I wasn't ever on that bandwagon, but I was skeptical. I still am, but to a much lesser extent. The reason why: Obama lawyered up.

There's an old legal aphorism:

  1. If the facts are on your side, pound the facts.
  2. If the law is on your side, pound the law.
  3. If neither the facts or law are on your side, pound the table.

Obama isn't even doing #2 -- arguing what "natural-born" means. From my non-lawyer's point of view, seeking dismissal due to lack of standing is #3... the equivalent of "How dare you even ask the question!"

Exactly. I like your legal analogy. :-)

I never cease to be amazed at how little people learn from past mistakes. Obama is currently making the same mistake Bill Clinton made....he thought that he was smarter than the American People. He mistook his own popularity for a tacit mandate to get away with anything. Look at Clinton now, he's the punchline to a bad Monica Lewinsky joke.

The new season of '24' comes out this weekend....the American people are on to The Next Big Thing in Entertainment. And the MSM will toss Obama under his own bus, if it will get them better ratings. "Obama LIES to America!" will put ratings through the roof, and if there are any bloody riots that go along with the headline, so much the better. (msm opinion, not mine...)

So, the honeymoon is very nearly over. Hopefully, the MSM will grab ahold of this story before the SCOTUS kicks the story under the carpet, or the Electoral College has its say.

Now that is an interesting theory. Not sure I agree that MSM is ready to trash the messiah, but I like the idea of that happening. And yes there will be violence - all started by those from the left, not the right.
