The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.
The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.
WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.
The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

However, there is mention that he may have travelled on an Indonesian passport to India and Pakistan when he was 20 years old.
Indonesian passports had to be renewed every 5 years and I don’t know if travelling under same after the age of majority is an act of affirmation that renounces your citizenship ...
Bring everything negative about Obama into question? Have you seen my posts noting things I think are a real issue, including the failure to release the bc? There is a difference discussing the legal ramifications of such a release and asserting that it should not be released. I would love to see it released.
This is a nuanced subject with many areas to investigate. If you don’t want to discuss facts, and just want me to agree, that’s not intellectual debate. That’s ideology.
No I am saying that when the votes are presented and counted that if a Senator and a Rep raised questions, objections, challenges then the joint session dissolves and each House takes up the issue/s. I said nothing about a Clerk. Cheney will be the presiding officer over that session and will receive and rule on objections. It is all in the Constitution.
I saw that about the travel, very plausible and not surprising. He seems to have been on an identity search forever. (Have you read Shelby Steele’s take on this issued?) It just it hard to believe that he could have had an Indonesian passport. There is a poster here with first-hand knowledge of Indonesian citizenship laws. I’d like to hear his/her take.
It would be a career ending move at least.

In my view, riots or not, the Supreme Court is about nothing if it is not about upholding the Constitution.
We’ve had riots before and survived.Nothing is more important than the rule of law.
And the Const. is very clear on who is eligible for Pres.The court would have to vote unanimously that O is not eligible if he cannot prove he is and there is proof that he is not.Period.

Another fact to consider is that the state of Hawaii, under statute, ONLY releases the short form. While I absolutely understand the desire to see the entire long form (vault form), I am VERY hesitant to have the executive branch usurp state law.
The Constitution trumps State Law:
Constitution:
“No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.” (Article II, Section 1, Paragraph 5).
Constitution:
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” (10th Amendment).
While NOT SPECIFICALLY spelled out, the Founding Father’s CLEAR intent was that NO non natural born citizen be POTUS. To that end, they would DEMAND verification in case of a controversy.
Thus, SCOTUS (or the Executive Department or Congress) IS ENTIRELY within their right to DEMAND proof in form of the ORIGINAL document. (Best Evidence Rule).
The best evidence rule is a rule of evidence in the United States that requires that when writings are introduced as evidence in a trial, the original writing must be produced unless the party can account satisfactorily for its absence. In Federal practice, however, any exact copies of the original carry the same legal weight as the original unless their authenticity is in question.
The rule applies in two situations:
1. Where the terms of the writing are legally dispositive in the issue at bar (not collateral documents or issues).
2. Where the witness’s sole knowledge of a fact comes from having read it in the document.
An exception exists where if the original document is unavailable for reasons other than serious misconduct of the proponent, secondary sources of evidence (e.g. oral testimony) can be used in place of the original.
Do you (or anyone else) know what the numbers were on the three bills that were originally submitted with regard to the changes in “natural born status”? I think one was S 2678, but I haven’t found information on 2 more.
I am also trying to find out where it was I read that a republican pointed out that there was stuff in the bill that shouldn’t be there for McCain, that would have covered Obama if he was born outside the U.S. Please post a link if anyone finds this.

Steinbeck always my favorite writer, and yet I never did read The Moon is Down until last winter—had it mixed up with a book he wrote about Russians (maybe Poles) & the old aristocracy. What about “It Can’t Happen Here”? who wrote that and is it in libraries?
