President-elect Barack Hussein Obama has until today to verify that he is in fact a natural-born citizen, according to www.obamacrimes.com, a Web site owned by Philip J. Berg.
It is clearly stated in Article 2, Section 1 of the U.S. constitution that “no person except a natural-born citizen or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of president; neither shall any person be eligible to that office who shall not have attained to the age of 35 years, and been 14 years a resident within the United States.”
Berg has a substantial amount of evidence for his claim that Obama was not born in Honolulu, Hawaii, but rather that he was born in Momboso, Kenya. Berg’s site paid for a full-page ad in the Washington Times on Nov. 17 to lay out the accusation and the grounds for it. First, Berg claims to have a tape of Obama’s paternal grandmother, Sarah Obama, saying “I was in the delivery room in Kenya when he was born Aug. 4, 1961.”
The article goes on to say experts have called the scanned copy of Obama’s birth certificate that he presented forged. Berg was quoted as saying, “It’s clearly been altered,” which would invalidate the document. Also, at the time he was born, Hawaiian law allowed for people to register for the non-hospital short form certificate up to one year after the date of birth. Thirdly, if Barack Obama did indeed attend school in Indonesia under the name of Barry Soetoro, he would have been required to be a citizen of Indonesia. During this time his citizenship was listed as Indonesian, his religion was listed as Islam, and his father was supposedly Lolo Soetoro. At this time no dual citizenship was available, and if he had been adopted by his stepfather he would have forfeited his American citizenship. Ultimately the issue at hand is the U.S. Constitution, that single document that truly makes this country great. Without it, we as a nation are nothing, but when it is upheld as it should be and as our framers intended it to be, our country is truly great. There are very few requirements for becoming the president of these United States.
Supreme Court docket No. 08-570, viewable at origin.www.supremecourtus.gov, shows that a petition for a writ of certiorari before judgment filed was filed Oct. 30, and the response is due today.
It is beyond comprehension why Obama has continued to fight these allegations, rather than simply producing the document for the whole world to see. Something must be fishy, as just getting it out in the open would have completely done away with the issue months ago.
If in fact Obama is found to not be a natural-born citizen, the Supreme Court will be forced to invalidate the election and another election will be held.

According to the Constitution, a president must be a natural born citizen of the U.S. Mr. Obama’s critics have failed to force him legally to produce his original birth certificate, and Mr. Obama has resisted any attempt to make him do so. Currently, only Hawaii Department of Health officials have access to Mr. Obama’s original records.
Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, said if it were to be discovered Mr. Obama were not eligible for the presidency, it would cause many problems. They would be compounded if his ineligibility were discovered after he had been in office for a period of time.
“Let’s assume he wasn’t born in the U.S.,” Mr. Vieira told The Bulletin. “What’s the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can’t make him president. So what’s the next step? He takes the oath of office, and assuming he’s aware he’s not a citizen, then it’s a perjured oath.”
Any appointments made by an ineligible president would have to be recalled, and their decisions would be invalidated.
Somebody needs to tell the writer, Mark Erbacher, about Obama not being a “natural born citizen,” wherever he was born, as long as Barack Hussien Obama I was his father, married to his mother.

The next Constitutional requirement in selecting the POTUS is a vote of the electoral college. PERIOD.
And, we see the genius of the founders at work again.
There is NO binding requirement that they vote for Barry Soetoro ne Obama if he is found to be ineligible. They could vote for Biden, Hillary, Pelosi or whoever else they want.
In other words the popular election selected the electors. The electors are presumptively for Barry, but in fact are controlled by the Dem party. There will be some big behind the scenes thing where the Donks’ sort out who will replace “the President Elect” .
Maybe Howard Dean will be POTUS! LOL !!

Oh, Please! I don’t think I could survive another election. At least not this soon. Even talks about 2012 leave me shaky.
I’ve seen that figure. I don’t know what it’s based on, but he has fought numerous lawsuits in numerous states, and it’s not cheap to hire lawyers who work at that level.
So it’s a reasonable figure, it seems to me.

Beginning in October, Denofrio made his way up through the ranks of the courts until his constitutional question as to the meaning of “natural born citizen” reached the Supreme Court.
He submitted an application for an emergency stay to prohibit the use of what he called “defective ballots” in the state of New Jersey because they contained ineligible candidates for the office of President of the United States, and asked that the court order New Jersey Secretary of State (SOS) Nina Mitchell Wells to remove the names of Republican candidate John McCain, Democratic candidate Barack Obama and Socialist Workers Party candidate Roger Calero from New Jersey ballots.
According to Denofrio, the three candidates are not “natural born citizens,” as required by the Constitution to hold the office of President of the United States.
Denofrio also quotes a section from the U.S. Department of State’s Foreign Affairs Manual, which states, “Despite widespread popular belief, U.S. military installations abroad and U.S. diplomatic facilities are not part of the United States within the meaning of the 14th Amendment. A child born on the premises of such a facility is not subject to U.S. jurisdiction and does not acquire U.S. citizenship by reason of birth.”
“The Foreign Affairs Manual also addresses the issue of eligibility for president as such: “It has never been determined definitively by a court whether a person who acquired U.S. citizenship by birth abroad to U.S. citizens is a natural born citizen within the meaning of Article II of the Constitution and, therefore, eligible for the Presidency.”
Denofrio cites 8 USC 1402(a): that McCain may claim his citizenship because of the statute. But does that make McCain a “natural born citizen”?
Denofrio states, “McCain is in the class of citizens who obtain their citizenship at birth, but not from the Constitution, but rather federal statute.”
...had the U.S. legislature intended to grant ‘natural born citizen’ status to all who were born on U.S. soil, then the 14th Amendment would contain the words ‘natural born citizen,’ but it doesn’t … McCain was born in Panama. Panama is not considered U.S. soil, nor has it ever been considered as such.”
The Naturalization Act of 1790 stated, “… the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens …”
However, Denofrio points out the Naturalization Act of 1795 specifically repealed the 1790 act and replaced it with the same clause except with the words “natural born” deleted.
Denofrio states McCain was born in Panama, Calero was born in Nicaragua and Obama’s birthplace has not been verified.

Aw, what the heck. Just suspend all the provisions of the Constitution, and rule by edict. Much more efficient form of government, gets away from all that tiresome representative republic stuff.

I’m very interested to see any judicial announcements this week. However, I don’t think that disqualification of Obama would result in new elections. There is no provision in the constitution for this. What I can see happening is McCain and the next two highest electoral vote getters being voted on in the House as prescribed by the constituion because no one other than Obama would have a majority of electoral votes.
Yes, it is beyond comprehension why Mr. Obama will not simply produce the documentation and let the chips fall where they may.
He should produce all birth records, both from the hospital and from whatever governmental bodies may hold them, and he should also produce documentation of his citizenship or visa status for his long stay in Indonesia. He should also produce all passports that he holds, both current and expired. The matter of his visit to Pakistan should be documented by producing the passport that he used and he should show the exact visa that he had for that trip.
There are clear records showing that he was registered in school as an Indonesia citizen; he has admitted on his campaign website that he was a dual citizen of Kenya; he has obviously a very complex status as a citizen of as many as four countries, and it is intolerable that any such dismal lack of clarity with respect to citizenship exist for anyone who would serve as President of the United States.
All facts must be brought into the light of day, and all documents must be produced.
