Soldier doubts eligibility, defies president's orders

A U.S. soldier on active duty in Iraq has called President Obama an "impostor" in a statement in which he affirmed plans to join as plaintiff in a challenge to Obama's eligibility to be commander in chief.

The statement was publicized by California attorney Orly Taitz who, along with her Defend Our Freedom Foundation, is working on a series of legal cases seeking to uncover Obama's birth records and other documents that would reveal whether he meets the requirements of the U.S. Constitution.

"As an active-duty officer in the United States Army, I have grave concerns about the constitutional eligibility of Barack Hussein Obama to hold the office of president of the United States," wrote Scott Easterling in a "to-whom-it-may-concern" letter.

“My nephew is in the Marines, and I was picking on him about his new “boss”. He stated, “He’s not my ‘boss’. He’s a fraud”, and he indicated that there are many many more who hold the same sentiment.”

I was speaking with a Homeland Security employee last night...same sentiment. Many insiders are aware of BHO’s eligibility questions.

Courts do all kinds of extraconstitutional and anticonstitutional things all the time. Or hadn’t you noticed?

I'm neither a politico nor a sycophant, and I am most certainly not among Obama's supporters.

But I am, stoutly opposed to "soldiers" who would arrogate to themselves the right to decide who is, and is not, qualified to be their commander in chief.

History shows the consequences of such behavior -- be it the fate of Rome, or Germany, or any number of modern-day African or Latin American countries. Mr. Easterling has no place in the armed forces.

r9etb.....help my memory out here.

When did German soldiers decide who was, and who was not, qualified to be their Commander in Chief?

And what were the consequences?

This is a very interesting case to me, as both attorney and retired TV reporter.

One could argue that Obama has no viable position here, other than producing the original copy.

If JAG tries to argue lack of standing, then who does have standing, and it's a PR disaster. This young man is willing to put his life on the line for this Commander in Chief and his country. All he asks is that the Commander in Chief take 15 minutes to reassure this young man, and every other service member that the orders they are being required to follow, do in fact come from a legal authority.

This officer could argue that absent proof that the order comes from legal authority, he places himself in jeopardy of being accused of murder, because if he kills someone offensively, and he did not have the standing of an armed combatant following legal orders, then he is simply a criminal.

From a legal standpoint, if Obama tries to simply discharge him, then that opens a huge door for everyone else to get out. It also creates problems for FBI, Secret Service, etc. to be in very questionable status in following orders. What then is status of all Presidential appointees, etc, and their orders to their staffs.

Are charges dismissed against the Cole bomber or are they not?

From a PR standpoint, if Obama tries to argue standing, accept the copy, or forced discharge, they open door for huge PR campaign, which is exactly what this officer wants!

The path from here out is VERY interesting.

If Obama produces the real copy, then it's all moot.... but then why has he not produced it so far.

I had four “real” trial lawyers review this case and the unanimous conclusion and comments were;

“Huh? Why doesn't he just produce the vau............ Hey, let me read that damn thing again! “

Just to begin with, I'm sure you've heard of Ludendorff and Hindenburg in the First World War.... Hitler, too, depended for his ascent on the support of the German military commanders.
