Handgun's Color Leads to Lawsuit (Alan Gura from D.C. v. Heller strikes again!)

A D.C. woman filed suit in U.S. District Court yesterday, claiming that the city would not let her register a pistol because of its color.

Tracey A. Hanson argued that her application to register a .45-caliber semiautomatic was denied because the gun is not on the California Safe Handgun Roster, which is the standard in the city.

Hanson tried to register a two-tone, stainless steel/black pistol, according to the suit. But the list has that model in olive drab green, dark earth or black, not in two-tone, stainless/black, the suit asserts...

If the California list turns out to be illegal in DC, it’s going to be illegal in California as well.

The California "testing" scam includes an expiration date for the approval on a given model as well. The manufacturer has to cough up multiple copies of a given model to go through the destructive testing. It's designed to be very expensive. Manufacturer's only submit models for which they expect enough sales to justify the cost of the "testing".

I would have just spray-painted it black. Rustoleum® makes a paint for plastic that rubs off of metal (non-plastic) surfaces.

You know I saw this article from another source and it started me thinking...that when we had our FNRA fund raising dinner last year....one of the prizes was the same drab olive green gun and in CA it could only be presented as a prize for that one time because it’s color had not yet been legally approved for sale in CA. There was another gun just like it in a different color and it was legal!

I plan on double checking our FNRA sources to make sure, but as I remember there was some kind of legal problem with it’s color.....DC and CA gun haters need to make up their mind and quit making up STUFF!!

Strange. There is no restrictions on handgun importation that I know of in California except a 10 round magazine limit.

The is a list of CA DOF-approved handguns.

Effective January 1, 2001, no handgun may be manufactured within California, imported into California for sale, lent, given, kept for sale, or offered/exposed for sale unless that handgun model has passed firing, safety, and drop tests and is certified for sale in California by the Department of Justice. Private party transfers, curio/relic handguns, certain single-action revolvers, and pawn/consignment returns are exempt from this requirement.

You are considered to be a personal handgun importer as defined by California law. You may bring all of your otherwise California-legal firearms with you, but you must report all of your handguns to the DOJ within 60 days as required utilizing the New Resident Handgun Ownership Report. [PDF 518 kb / 2 pg] You are not required to report rifles or shotguns. You may not bring ammunition feeding devices with a capacity greater than ten rounds, machineguns, or assault weapons into California.

As you can see the operative words are “for sale.” So basically you can bring any handgun into the state that you want so long as it only has a 10 round capacity. I haven’t seen any handguns that are for sale outside of California that are not for sale inside of California, with the exception of magazines with higher capacities then 10 rounds. California is a huge market for guns despite the ridiculous laws.

Oh.. And you can see that private party transfers are exempt. So the law is basically moot.
