A California attorney whose emergency submission to the U.S. Supreme Court on President Obama's eligibility was turned back without a hearing or comment now is submitting a motion for re-hearing, alleging some of her documentation may have been withheld from the justices by a court clerk.
The motion for reconsideration alleges a court clerk "of his own volition and on his own authority refused to file of record, docket, and forward to the Chief Justice and Associate Justices petitioners' supplemental brief presented on January 15, 2009."

“Quo Warranto” - Latin - (By) What Authority?
Go to Leo’s web site. He has published a three part “tutorial” on Quo Warranto. Be advised it is a heavy read, however, if you have time I’d recommend that you do.
Essentially, the Attorney General and the US Attorney for DC, by federal statute, can bring a Quo Warranto for ANY public official in the DC area questioning why they should have “title” to their position.
It’ll also keep of military members out of the fray and protect them from prosecution under the UCMJ.
Fat chance that AG Holder will act. US Attorney, Jeffrey Taylor is a Bush holdover... we’ll see.
That being said... “Non-sequitur, Non-sequitur...come out, come out where ever you are!”
Would be nice if some Justice reached out and took on the case to somehow bounce it down to the appellate level. Maybe would just take one to say publicly, “Hmm...” and some appellate level would take the cue.

I am not a lawyer... but, from what I’ve gathered - if 0 were found to be ineligible to serve, then we’d have President Biden, who’d pick a new VP, who would have to be confirmed by congress.
R U sure...seems to me if O were found to ineligible then the election of him to be POTUS and Biden VP would be void...seems like we'd have to at least have another election or maybe McPain would be the POTUS since he came in second...but I shirley don't think that Biden would be POTUS simply because O was ineligible because NO ONE voted for Biden for POTUS...LOL
But. . . do you not think a good argument could be made, that if the president was elected on fraudulent grounds, that he therefore is not the president, the election is void, and the 25th amendment does not apply?

No. There is nothing in the Constitution about do-overs. The election was valid. Obama was elected and inaugurated. He is the president. If he is removed for any reason including fraudulently occupying the office then Biden becomes president. The Constitution doesn't allow for anything else.
They did that with Berg's case. Told him to get lost until the appeals court had ruled. That doesn't mean they think the case has merit, it just means that the lower courts need to do their job first.

Here’s what will happen.
Obama will be asked to “please vacate the premises.” He cannot be impeached but can be charged with other federal offenses.
Biden becomes Prez, Hillary is recruited/appointed VP.
Biden has “a health record episode” and resigns.
Voila! Hillary’s now Prez.... the plan all along?
