Natural Born is Not Ambiguous

The words “natural born” are depicted in fact. The word “Citizenship” relates to a legal status. “Citizen” when used alone is defined within the US constitution in Amendment XIV to describe what persons would fall into the category of US Citizenship. There also are several points of reference describing US citizenship including USC Title 8 and precedent setting cases (US v. Wong Kim Ark and Perkins v Elg). Meanwhile there are no laws or precedents existing to describe those who may or may not be a “natural born Citizen”. This is most likely because “natural born citizen” is not a legal status. It is a statement of fact. The other reason is because this unique qualification only applies to the President of the United States. To the best of my knowledge, there are no other distinctions between a “citizen” (natural, native, naturalized, or other) and a natural born Citizen. The qualifier “natural born” means that one’s “Citizenship” is absent of ambiguity – meaning both of your parents were US citizens & you were born on US soil. According to the writings of the framers of the constitution, this qualifier was put in to avoid any loyalties to any other country and at the time in particular, England. Provisions were put in to allow those who were Citizens at the time of the signing to become President.

Which means he would have been passed over in the line of succession had it ever gotten that far. After the President pro tem of the Senate would have come the Secretary of the Treasury.

State, then Treasury.

Yeah, the typos are much worse then the point and content.

Give us a staff and maybe improvement will follow.

Actually he wasn’t as there was no hospital on the military base, so his natural born status is also in question; at any rate, this has been discussed many times on these threads. But he definitely was NOT born on a US military base.

But John McCain WAS born to two U.S. citizens, and as such, under U.S. law, was a citizen at birth.

A citizen at birth is a “natural born” citizen; as opposed to a “naturalized” citizen that had to go through a legal process for citizenship.

That’s the claim that you’re making, and your arguments are not very compelling if being called “stupid” is your main one.

It is the claim that is true.

There are natural born citizens and naturalized citizens. There is no other category under the law.

As long as birthers are just making things up why not claim that “natural born” means born to two U.S. citizens on U.S. soil who were also both born on U.S. soil?

I mean as long as you would rather make things up than look at the law, the sky is the limit!

We’re talking about when Henry Kissinger was at State. Had something happened to everyone in the line of presidential succession above him, he would have been bypassed in favor of the Treasury secretary.

Oh, that makes sense. I thought you were talking generally, I guess I lost the thread of the thread.

McCain was born on a military base which is considered to be US soil.

No it is not. Being born on a U.S. soil means that the person is automatically a citizen per the 14th Amendment. But if a Panamanian national gave birth in the Canal zone or a German national gives birth on a U.S. base in Germany then in neither case is the baby a U.S. citizen of any kind.

Children born on U.S. bases abroad are considered natural born citizens because their parent or parents are U.S. citizens. However, that is in part what this whole arguement is about. By the strict definition of natural born citizen promoted by D'Onofrio and the author of this article, McCain is not a natural born U.S. citizen.

A natural born citizen is thus one who did not need a “naturalization” process to become a citizen, as by the natural act of being born they are a citizen.

I'd agree. But that may not be what he really wants to talk about. Scroll down.

Likewise, you could have been born a hermaphrodite, having the characteristics of both male and female. You could legally adopt the gender that you presented yourself. You could undergo surgery, modify your physical structure, and adopt the gender of your preference. You could live out the rest of your days and no one would question your gender from that point forward. But the unfortunate fact would be that you were naturally born ambiguously gendered, not naturally born male or naturally born female. This is not necessarily a bad, thing. It just is what it is – a fact.

Barack Obama is the equivalent of a hermaphrodite citizen.

Quite a digression. All that citizenship stuff just to find an excuse to use the word "hermaphrodite."
