UNREAL. Obama May Allow US Soldiers to be Tried in the Hague

Unreal. Team Obama may allow US soldiers to be tried in the Hague for war crimes. The Wall Street Journal reported, via Jihad Watch:

Secretary of State Hillary Clinton expressed “great regret” in August that the U.S. is not a signatory to the International Criminal Court (ICC). This has fueled speculation that the Obama administration may reverse another Bush policy and sign up for what could lead to the trial of Americans for war crimes in The Hague.

The ICC’s chief prosecutor, though, has no intention of waiting for Washington to submit to the court’s authority. Luis Moreno Ocampo says he already has jurisdiction—at least with respect to Afghanistan.

Because Kabul in 2003 ratified the Rome Statute—the ICC’s founding treaty—all soldiers on Afghan territory, even those from nontreaty countries, fall under the ICC’s oversight, Mr. Ocampo told me. And the chief prosecutor says he is already conducting a “preliminary examination” into whether NATO troops, including American soldiers, fighting the Taliban may have to be put in the dock.

“We have to check if crimes against humanity, war crimes or genocide have been committed in Afghanistan,” Mr. Ocampo told me. “There are serious allegations against the Taliban and al Qaeda and serious allegations about warlords, even against some who are connected with members of the government.” Taking up his inquiry of Allied soldiers, he added, “there are different reports about problems with bombings and there are also allegations about torture.”

It was clear who the targets of these particular inquiries are but the chief prosecutor shied away from spelling it out.

Asked repeatedly whether the examination of bombings and torture allegations refers to NATO and U.S. soldiers, Mr. Ocampo finally stated that “we are investigating whoever commits war crimes, including the group you mentioned.”

Hmmm...

This will likely lead to bloodshed if they attempt it.

Oh, and not to be petty, but is there anyone who stayed home on Election Day who thinks this story could have been written about John McCain? I hate RINOs, but RINOs don’t hand troops over to foreign powers for war crimes trials.

he;s getting away with all this because the emdia will not report most of what is going on.

They are either afraid or feel they need ot protect these radicals.

Either way we have to do a mass blitz on the media and have them know that we are not going to take their bias crap no more

The masses in this country have no idea what is going on because the media are not reporting it.

The amount of times I have mentioned to someone about ACORN and they say HUH is astounding.

Told a groups of blacks about how their messiah views homosexuals and they refuse to believe it.

The majority in this country has no clue because they are ill informed and ignorant.
The info is out there but they would rather see American idol or watch MTV.

It is all about me , me , me today.

Look at most students today who have their heads up their arse and think the world evolves around them

“Justice: As if fighting a war in Afghanistan isn’t hard enough, ambitious global prosecutors have rolled into Kabul looking to charge U.S. troops. Intentional or not, such legalism will sap U.S. morale as it did in Vietnam.

At about the time NATO’s new secretary-general, Anders Fogh Rasmussen, warned NATO’s European members against an early pullout, Luis Moreno-Ocampo, the top prosecutor of the International Criminal Court, whose body is charged with looking for international war criminals, announced he was looking for new “clients” from anyone with a grievance in Afghanistan.

At a briefing Wednesday in The Hague, Moreno-Ocampo said he had launched a new war crimes inquiry, seeking information about “torture” especially — a European obsession — and had already mined the human rights groups for stories. He added he was also “very open” to more information from foreign governments.

Oh, he’d been evenhanded in his Monday-morning battlefield quarterbacking of course, promising he’d prosecute both Taliban and NATO troops as moral equals.

But it doesn’t take a genius to know what the spotlight-loving attorney (who once launched his own reality TV show back in Argentina) is really after: Americans in the dock as war criminals.

The atmosphere that makes a prosecutor like Moreno-Ocampo ambitious enough to go after Americans instead of a real monster like, say, Fidel Castro, can only occur when the West’s will has weakened, as Rasmussen warned.

After all, if a war to defend our civilization can be reduced to a series of police-brutality cases, then Afghanistan isn’t about victory...”

This, from Wikipedia:

"The court is designed to complement existing national judicial systems: it can exercise its jurisdiction only when national courts are unwilling or unable to investigate or prosecute such crimes. Primary responsibility to investigate and punish crimes is therefore left to individual states."

Given the military and the UCMJ has jurisdiction over military members in signatory countries (sometimes even in the local countries' civil legal jurisdiction if defined in a Status of Forces Agreement), it seems if any cursory military legal investigation is done by the U.S. military, the ICC has no case. Perhaps it would require an Article 32 Hearing, rather than a local investigation.

Also, any nonjudicial punishment in lieu of courts martial should taken against a U.S. military member for violating the rules should prevent any ICC action for the same event.

If we had a President with balls, that is exactly what we would do. We would demand to be informed of any proposed ICC investigations, and we would investigate them ourselves, convene an Article 32 hearing if required, and tell the ICC to politely pound sand.

And this is supposed to make a potential recruit to our armed forces feel good about their decision to join and defend their country?

If Obama signs off on this, enlistment rates would probably fall big time. Oh wait, that's what this traitor wants. He is systematically tearing our institutions apart.

What is needed is our Congressional Medal of Honor and other top military award winners marching on Washington DC and reminding those independent voters about what it takes to be free.

we have a large segment ignoring islam and so Islam takes a hold.
We have laws being broken but they get away with it.

I agree if the media did their job and reported all of this then there could be an uprising but that will never happen and still how many are ready to do what ever is needed.

The majority I’m afriad do not care as it is all about them,.

This generation cares for themselves they have no love for this country no more.

Imagine that we get attacked like Pearl harbor , do you think that no everyone has to join the military there would be no protests, civil unrest from students.

It would be like the 60’s today.

Besides were were attacked and we had idiots saying we should talk to them. Now look at how it is , not even 10 years later and we elect barack hussein obama with radicals next to him. Look at his background.

No one cares, it is the American idol crowd now voting and protesting.
Many today have no stomach for a fight or even have a stomach to go to a fight.
Look at many 20 plus kids today and the men are like women, act like women, scream like women. They can’t fight but would rather sue, that is after mouthing off or giving a finger .
