Navy Seals Could Face Year in Prison Over Alleged Punching of Terrorist

The Navy Seals facing court martial for the alleged abuse of a terror suspect arrested for killing four Americans face up to a year in military confinement, discharge for bad conduct, and forfeiture of two-thirds of their pay for a year, if convicted, according to defense attorneys.

I read Admiral’s mast, but I have to be honest with you, it’s the first time I’ve heard the term also. I suppose that would be either the CinC for the theater, or perhaps the Top SEAL himself?

I say the damage is already done to the military ,
and with the amount of service people at Sara’s book signing , the non labeling of the ft hood killer , and now this against the elite ,

but then lets not forget upon returning they are now to be placed on the watch list

it is a truly sad time in America , and i know this plays heavy on the minds of our service men and woman trying to protect what once was a great nation

Any Republican who dares to run against this vile woman will be subjected to the gutter politics of that scumbag, Bob Mulholland.

I remember in '92 the first time she ran for the Senate (the much-vaunted Year of the Woman). They dug up a last-minute smear against her opponent, Bruce Herschenson, who would've made a great senator. This was mere days before the election, Herschenson didn't have time to respond to the charges (the same type of crap that the dems pulled with the Bush decades-old DUI).

And this was AFTER Blabs was found to be armpit-deep in the House banking scandal. She got elected and has been squatting there for three terms without any serious challenges. Simply disgusting :-(

The term arraignment puzzles me. Isn’t an Article 32 hearing the next step?

That the maximum punishment possible is one year confinement, a BCD, and forfeiture of two-thirds pay means they will face a special court martial, not a general court martial--so, no Article 32.

The process of serving charges and entering pleas in the military system is a little different than what is encountered in the civilian system. In the military system there are preferral and referral of charges to court martial followed by the trial. The trial itself is where the formal reading of the charges and entry of a plea first takes place. But unlike (most) civilian jurisdictions, a military court-martial proceeds directly to trial at that point.

The SEALs were offered nonjudicial punishment, but supposedly refused. The convening authority, Maj Gen Charles Cleveland (commander of Special Operations Command Central) , signed off on sending them to a court martial. He made the final call.

Looking further into this, Maj Gen Cleveland has convened an Article 32 investigation for a Special Courts Martial. From a reliable authority, the Article 32 determines whether to proceed or dismiss based on the merits of the case.

This just may go away shortly.

JAG's aren't the convening authority. Like anyone else in the military, they're following orders. If you've got a problem with the charges (as I do), then your beef is with command, not the attorneys prosecuting the case.

There will be an Article 32 hearing, much like a civilian preliminary trial with elements of a grand jury. That hearing will determine if the evidence supports a referral to a court-martial. But, the JAG corps is obligated to hold the hearing as the SEALs have refused Mast. They aren't "pushing" anything - the Commanding Officer is.

Were you reffering to the service members going to trial for ‘suppodly’ punching up a tango?

These man are SEALs. A Marine may apply and be accepted as a SEAL - but most, I suppose, just apply for Force Recon.

The SEALs are very porfessional. IMO, had the Marines trapped this asshat, they would have turned over a body, but then, that’s just me.
