36 States Aim to Preempt Federal Health Care Plan

Talk about your preemptive strike.

The success of national health care reform legislation is still an uncertainty, but some states are already taking measures to keep federal hands off their citizens.

Thursday, Virginia became the first state to enact a law exempting its residents from any health insurance mandates. It's one of 36 states where lawmakers are trying to head off potential federal legislation.

While Virginia enacted a statute, 25 other states are considering constitutional changes, according to the National Conference of State Legislatures. Virtually all the proposals object to mandates requiring individuals or businesses to buy health insurance.

"That is a widespread, common theme," said Richard Cauchi, program director for the NCSL health program. "The real legal issue is the requirement that every person buy health insurance."

In Arizona this November, voters will consider a constitutional amendment banning any requirement for individuals or employers to have or provide for heath care. This spring, the legislature is also consider a statute o allow the state to decline any public health care plan offered by the federal government.

The states will have to fight back and fight back hard. May they do so, and may the feds discover they have an entire citizenry in revolt over this! Kill the mandate and you have saved decent health care for citizens. No forced participation in a “pool” governed by the feds and the free market will take over. At least that’s what I pray!

This is the way to go. Simply nullify federal laws just like with the Real ID Act.

This is a great start. Next we can nullify other illegal federal intrusions such as minimum wage, education, etc. This is how the rebellion begins.

This is all just political spin, and meaningless in effect.

How will these States prevent Feds from taking their residents’ money for Obamacare? What will these States’ politicians do when Feds start throwing same money around for this or that project or benefit? Especially when some lefist States like NY State will be first in line for hand-outs?

This would have to be on a level that happened with the USSR collapse. States would have to be willing to form their own self reliance with no Federal assistance other than protection by the U.S. Military. No social security, medicare, medicaid, federal pensions, etc. It would be a shock and awe to the state’s citizens but they would have the choice to leave and go to another state or stay and be free of Federal take over. Would be interesting to see which states would flourish and which would not.

Thank God! I was hoping the states would step up & do something! These sob’s in DC have become dangerously arrogant & we need to defend ourselves against it - kudos to Virginia & all those who follow suit...

It would be meaningless if it were just a few states.

But 36? - that's the magic number.

If 36 states say 'we don't want this', the next step is to threaten and Constitutional Amendment over the issue, and 36 states is enough to get it done.

Tricare fee increases imposed last week by the Defense Department will be repealed by a provision of the compromise 2010 defense authorization bill unveiled Wednesday by House and Senate negotiators.

The fee increases were announced on Sept. 30 and took effect on Oct. 1, but the defense bill, HR 2647, includes a provision barring any fee increases until the start of fiscal 2011.

Retired Army Maj. Gen. Bill Matz, president of the National Association for Uniformed Services, said the announcement of fee increases was shocking considering that the Obama administration promised earlier this year to hold off on any new fee Tricare fee increases until fiscal 2011.

“President Obama and DoD assured NAUS and the entire military family earlier this year that there would rightly be no increases in any Tricare fees” in fiscal 2010, Matz said. “We took them at their word, and I can’t believe that a co-pay increase like this was allowed to go forward,” he added.

The article says the the Supreme Court is unlikely to uphold state's rights over this. Then what?
